Declan replies to the Independent Case Examiner

From the infamous Haringey Council (see previous blog) back to the Department for Work and Pensions! Declan currently has Jobcentre Plus of the Department for Work and Pensions before the Information Commissioner (see blog of 21 June “Department for Work and Pensions double breaches the Data Protection Act: Letter to the Information Commissioner”), as well as the Independent Case Examiner for refusing him access to a Starting a Business course that would enable him register NAC as a company limited by guarantee.

Yesterday the Independent Case Examiner, John Hanlon, got back to him, or at least one of his foot soldiers did (page 1 of the letter is archived here, page 2 here). For the record, this is Declan's reply, to be dispatched by registered post first thing tomorrow morning:

Dear Mr Hanlon

Jobcentre Plus (ICE Ref No: DWP00123/10)

Thank you for your letter dated 23 July 2010 regarding my complaint that Jobcentre Plus has failed to take timely and appropriate action to consider my request for access to a Starting a Business course. You have asked me to reply.

As I have already tried to explain, Business Link, to which I was referred by Jobcentre Plus on 11 March 2010, does not offer a traditional, classroom based, tutor led Starting a Business course. It offers only workshops and the web-based course to which you refer. I do not feel that your letter has adequately dealt with the issues I have raised.

Please would you clarify your finding in this case.

Next it's back to our MP, Lynne Featherstone (Lib Dem), who may be able to refer this complaint to the Parliamentary and Health Service Ombudsman. Only last month Featherstone wrote to Declan to advise that she has written to the Home Secretary about the blocking and manipulation of our email (her letter is archived here). Of course, that too continues unabated, to the extent that Gmail for us has been a virtual right-off for months now (see blog of 21 April “Interception of communications: Declan writes to our MP”).

It just so happens that tomorrow morning we have our “First Step Meeting” with A4e, which is contracted to deliver Flexible New Deal on behalf of Jobcentre Plus. Our nearest A4e branch is ten minutes away, in fact it is almost beside the Jobcentre, and yet we have been allocated an A4e branch two bus journeys away. This is quite concerning: why would the Jobcentre send us to another area? So great, I have just uploaded the new NAC website! There is loads of work still to do on it with the transferral and adjustment of material from the old NAC site and the like, but not having something up in time for this meeting tomorrow morning has not been an option all week.

A4e will surely not tell us that provisions of the Jobseekers Act 1995, particularly our right to an adjudication officer if we are not happy with a proposed Flexible New Deal contract, no longer apply to us - not that we can do nothing about it if they do. But who knows? It was, after all, the Department for Work and Pensions which put us to the street for more than 2 1/2 years (see blog of 9 May “Declan calls for Department for Work and Pensions evidence”).

The Infamous Haringey Council

In yesterday's blog “Declan appeals Haringey Council's eviction notice”, I published an excerpt from Declan's appeal against Haringey Council's decision to pay our landlady 60% of her rent from next week. Haringey Council is infamous in the UK for the shocking case of Baby P. The 17-month-old boy suffered eight months of abuse and beatings at the hands of his mother's sadistic boyfriend. Baby P died in August 2007 despite being on the child protection register and being seen 60 times by health and social workers.

Declan appeals Haringey Council's eviction notice

Organised by Declan and NAC Honorary Associate Dr. Jim Fetzer (US), Wednesday night's international symposium “Debunking the ‘War on Terror’” was a great success, according to NAC Honorary Associate Dr. Kevin Barrett (US), who was one of the speaker's at the event (see here). The next morning (yesterday), Declan effectively received an eviction notice from Haringey Council! They will only pay our live-in landlady, Belinda McKenzie, 60% of her rent from next week (see an article in the New Statesman stating that Belinda’s house “doubles as the hub of the British and Irish 9/11 Truth Campaign” here). This is an excerpt from Declan's appeal of today's date, which has just been dispatched by registered post:

My rent is currently £500 pcm. In a letter dated 14 January 2010 (copy enclosed) my live-in landlady, Mrs Belinda McKenzie, informed Haringey Council Benefits Service (HCBS) that my rent was due to increase on 14 April 2010 to £600 pcm. This change in my circumstance was processed by HCBS and a notification letter was sent to me on 10 March 2010 (copy enclosed). This processing of my change in circumstance did not result in an increase in my rent.

In a subsequent letter dated 14 June 2010 (copy enclosed), Mrs McKenzie informed HCBS that my rent is due to increase on 24 July 2010 to £1,060 pcm. I reported this change in my circumstance to HCBS by registered letter dated 15 June 2010 (copy enclosed). By a Benefit Decision Notice dated 12 July 2010 (copy enclosed), I have been informed that my claim has been amended to £153.46 pw.

I would like the decision not to pay Mrs McKenzie the full sum of £1,060 pcm from 24 July 2010 looked at by the Tribunals Service, and appeal against it. I beg to point out that the sum of £1,060 pcm is below the Local Housing Allowance.

In the previous blog I mentioned MI5 whistleblower David Shayler, who lived for a couple of years in one of the rooms below us. According to the BBC, Shayler “caused the biggest crisis of official secrecy since the spy catcher affair”. Is a squat what Haringey Council has in mind for us (Shayler is the one sitting on the chair)?

Declan has to fight for his Labour Party membership card

In previous blog “Getting through to Tower Hamlets Councillors”, I published an email NAC Honorary Associate Dr. Jim Fetzer sent to the councillors of Tower Hamlets Council about tomorrow evening's symposium in Friends House, “Debunking the ‘War on Terror’” (NAC carries the website I produced for the event here). The email starts:

Organized by Labour Party member Declan Heavey (UK) and Dr. James Fetzer (US), the forthcoming “Debunking the ‘War on Terror’” symposium in London brings together four of the most outspoken and eloquent challengers to the Zio-American imperial order that has emerged post-September 11th.

Well, this morning Declan was at Labour HQ to enquire about the whereabouts of his Labour Party membership card. His application of 5 July 2010 “is not on the system”, he was told by Robert Atkinson of the Election Strategy Unit. Of course, we still have the Labour Party's letter of 5 July 2010 confirming their receipt of Declan's completed membership application including payment of the first years membership subscription (archived here).

This is Declan's (stage 1) email to Atkinson this afternoon:

Subject: Labour Party membership application and payment

Dear Mr. Robert Atkinson,

I refer to our meeting this morning at Labour Party HQ.

I understand that my completed membership application of 5 July 2010 including payment of the first years membership subscription is not on your system due to clerical error.

Please would you let me know as soon as this error has been rectified.

Declan has been spending all our spare welfare money on travel tickets, making hundreds of photocopies, which he has distributed to mosques all over London, organisations and even Councillors, etc. Dr. Fetzer and NAC Honorary Associate Dr. Kevin Barrett, also from the US, have been in London for a few days - they have been given lodgings by our live-in landlady Belinda McKenzie. Actually we are so skint, I can't even cook a meal for them!

The symposium has also taken up a lot of my time and I have been unable to do much on the NAC website. Despite that, last month the site had 4,515 visitors. Anyway, I am turning NAC into a WordPress theme and in less than a month it will be unrecognisable. I am using the same theme as Project Censored and I am tremendously excited about it.

To think that this time last year the police were threatening Declan and me with physical removal from the porch we were sleeping in, after having been forced by the Department for Work and Pensions to sleep rough on the streets of London for more than two and a half years (see blog of 12 July 2009 “Police threaten us with physical force at the place we sleep, Salters”). Getting through to Tower Hamlets Councillors

Below is a letter that NAC Honorary Associate Dr. Jim Fetzer is going to email this afternoon to every councillor in Tower Hamlets Council regarding our symposium next week on the so-called “war on terror”. Tower Hamlets is the No.1 Muslim borough in London and a Labour stronghold. The current political composition of the council is 41 Labour Councillors, 8 Conservative Councillors, 1 Liberal Democrat Councillor and 1 Respect Councillor. Last night, Declan managed to collect 17 email addresses for Dr. Fetzer from the council's “Meet your councillor” web page. However, since 10.30pm last night neither Declan's notebook nor my laptop can access the links to the individual councillor's web page. Fortunately, our live-in landlady has no difficulty accessing these pages, so this morning it was off for me to the local internet cafĂ©.

Gilad Atzmon (UK), who will be speaking on "From Promised Land to Promised Planet: Zionism and Neoconservatism", is an outspoken opponent of Zionism and highly critical voice of Jewish identity politics. An Israeli-born British jazz saxophonist, his album "Exile" was the BBC's "jazz album of the year" in 2003. He is also an acclaimed novelist and political essayist whose views on Zionism, empire and resistance provocatively challenge the boundaries of what passes for polite Western discourse.

Dr. Kevin Barrett (US), one of America's best-known critics of the "war on terror," has been blacklisted by the University of Wisconsin since 2007 due to his political views. A Ph.D. Arabist-Islamologist, he is the author of Truth Jihad: My Epic Struggle Against the 9/11 Big Lie (2007) and of Questioning the War on Terror (2009/2010) as well as the lead editor (with theologian John Cobb and Jewish Studies professor Sandra Lubarsky) of 9/11 & American Empire Vol. II: Christians, Jews, and Muslims Speak Out (2007; Arabic version 2009). He will address, "Islam, Neoconservatism, and the Unwarranted 'War on Terror'".

Dr. James Fetzer, Distinguished McKnight Professor Emeritus at the University of Minnesota Duluth, is the founder of Scholars for 9/11 Truth, a non-partisan association of faculty, students, and scholars, dedicated to exposing falsehoods and to revealing truths behind 9/11. Scholars was the first 9/11 research society to make an impact on public discussion about the events of 9/11. The Scholars' first book, The 9/11 Conspiracy (2007) and DVD, The Science and Politics of 9/11 (2007), provide evidence of a conspiracy and cover-up, which was designed and executed to manipulate the American people into supporting illegal wars and unconstitutional measures out of the fear those atrocities induced.
