Injunction hearing against our live-in landlady

As I flagged up in the previous blog Facebook's recommendations attacked, yesterday Declan had a court hearing for an injunction against our live-in landlady, human rights activist Belinda McKenzie, after she had her Polish builder break into our flat on 27 July through a locked door and make off with the door while Declan was on a 999 call to the police. Due to a legal technicality (a claim had to be first issued), District Judge Sterlini didn't grant Declan the injunction. Instead, Belinda had to give an undertaking to the Court promising "not to interfere with the claimant's quiet enjoyment of the accommodation he occupies at part of 83 Priory Gardens, London, N6 5QU, comprising the third floor studio flat, pursuant to a tenancy granted on 14/07/09".

Belinda also had to sign a declaration on the form stating "I understand the undertaking that I have given, and that if I break any of my promises to the Court I may be sent to prison for contempt of court". Nevertheless, we still can't leave the flat together due to an email Belinda wrote last January stating that her builder might dismantle our kitchen or bathroom. Who's to say that we would not come back to a cooker that doesn't work? And how could we prove a breach of the undertaking? Already today we have lost access to the internet, having been denied access to Belinda's "Guest" wireless network connection. This was the 111th time we have lost access to the internet since Belinda was forced to withdraw her claim for possession of her flat on 19 April due to the "wrong information" she provided the Court, to quote from an email of hers later that day.



Perhaps Belinda is fortunate there was an error in Declan's application and the injunction wasn't granted by the judge. As Declan stated in paragraph 4 of his defence to the possession order Belinda previously sought, back in 2009 she wrote an email to an associate of ours in America stating she would like her house to become an "in-house charity" for impoverished activists supported by "some kind of international fund". Had Declan been granted the injunction, the board of trustees might have had an impossible task convincing the Charity Commission that 83 Priory Gardens is above board and a suitable place for activists from around the world; WikiLeaks' Julian Assange, for example.

In the same email, Belinda confirmed that MI5 whistleblower David Shayler lived for a couple of years in one of the rooms below us until 2007. It is unfortunate Shayler then declared that he was the Messiah, became a squatter, and was subsequently ridiculed in the press for changing his name to Delores Kane. A New Statesman article dated 11 September 2006 featuring Shayler and Belinda gives no indication that Shayler believed he was the Messiah at that time; whilst a Daily Mail interview with Shayler explicitly shows he believed himself to be Jesus by June 2007.

Facebook's 'recommendations' attacked

Declan has been quite busy since our live-in landlady, human rights activist Belinda McKenzie, had her Polish builder break into our flat through a locked door and make off with the door while he was on a 999 call to the police. In fact, on Tuesday Declan has a court hearing for an injunction that prevents Belinda from entering our flat without his consent. I have been kept quite busy too: last week the N4CM website was vandalised, and now Facebook's 'recommendations' are under attack!

N4CM homepage vandalised

When the N4CM website was vandalised on 14 June, my wordpress theme designers told me that I had no choice but to change the theme I had been working with for over 2 years, which I did (see blog here). The website was vandalised again on Saturday after I published an article by our chairman’s friend and collaborator for 35 years, Don Collins. It is a superb article, just as good as the well documented and footnoted piece by Mr Collins that Facebook blocked on 10 June because of its alleged "abusive" content. Fortunately this time my theme designers were able to help me reconstruct the N4CM site, although it remains a complete mystery as to how it fell apart in the first place - when I did absolutely nothing.

The internet cuts continue unabated. As of this evening - when we were cut again - we are up to 106 recorded cuts since 19 April, the day our live-in landlady, human rights activist Belinda McKenzie, was forced to withdraw her claim for possession of our flat due to the "wrong information" she provided the Court, to quote from an email of hers later that day. Declan’s injunction hearing against Belinda is scheduled for next Tuesday at Clerkenwell and Shoreditch County Court following her builder's removal of our flat door on 27 July (see previous blog, Property Warrant: Open Letter to the Prime Minister).

Property Warrant: Open Letter to the Prime Minister

Our live-in landlady is human rights activist Belinda McKenzie. On 27 July, Belinda had her builder force entry to our flat through a locked door and make off with the door and Declan’s house keys (which were in the door) as Declan was making an emergency 999 call to the police that must have lasted 10 minutes or more. Who continues vandalising a property in the middle of a 999 call? I blogged stunning photos of the entire incident as we were waiting for a senior police officer to arrive on the scene (see here). This is Declan’s letter this morning to the Prime Minister enquiring if a warrant has been obtained for this property, which the Home Office will neither confirm nor deny:

Belinda is not your usual 60+ landlady. I cannot list all the causes she is involved in, there are so many. She is active in groups dealing with issues as far-ranging as abuse in the church, anti-war activism and lay legal advocacy, and has been involved with the Iranian community for more than 20 years; she is even described as a "noted philanthropist". As Declan points out in his letter to the Prime Minister above, MI5 whistleblower David Shayler lived for a couple of years in one of the rooms below us until 2007. The Esquire article below is mentioned in a Guardian article dated 27 March 2012. It is an eye-opener, highlighting the monitoring and surveillance that Shayler had to live with back in 2000, and the contradictory briefings and slanders that were coming out of the British establishment and the media. The author, Dr Eamonn O'Neill, now a lecturer in journalism at Strathclyde University, also intelligently tries to address the motivations of a whistleblower.

According to BBC Panorama, Shayler "caused the biggest crisis of official secrecy since the spy catcher affair". In 2002, he was jailed for seven weeks for breaking the Official Secrets Act.
