For the second time in less than a month this blog has been vandalised, and in exactly the same way: by logging into my account in tinypic.com and deleting a graphic. The first time, on 21 January, it was an email Declan received from Haringey Borough Commander Det Chief Supt Sandra Looby concerning a written threat we received from our live-in landlady, human rights activist Belinda McKenzie, to have us physically removed from our flat with the help of her Polish builder - a few hours before I received an email from Twitter telling me that the Network for Church Monitoring Twitter account had been compromised and I should change the password.

This time it is a response Declan received from the chief executive of Companies House - the government body charged with registering all companies in the UK, including non-profits - confirming that when it comes to annual returns, the Head Office in Cardiff, Wales doesn't acknowledge receipt of documents filed on paper in their London office which are then delivered across the country to them by overnight van. The email is back now.

Despite that reliable home internet access has been part of our rental agreement since our tenancy began in July 2009, Belinda has given us so many excuses for not fixing the atrocious internet speed we often get that I couldn't possibly enumerate them all. On 3 January 2012, she wrote: "I'm not going to mess about any longer with ‘half measures’ - I will call Virgin first thing tomorrow and book an engineer to move the modem from the middle floor upstairs to you". She changed her mind the next day!

Neutralized MI5 whistleblower David Shayler lived for a couple of years in one of the rooms below us, until 2007 more or less; see N4CM blog of 25 January "Property Warrant: Open Letter to the Prime Minister" for some stunning photographs of Shayler since 2007. Pulitzer Prize-winning reporter Chris Hedges has a very informative piece in Truthout about what he sees as familiar patterns in the assault against the Occupy movement. Top of the list is to "physically eradicate the insurgents' logistical base of operations to disrupt communication and organization". Sounds familiar to us too.

Letter to the Chairman of Companies House

The first time Declan had any dealings with Companies House - the government body charged with registering all companies in the UK, including non-profits - he was told that Network of those Abused by Church was an "offensive company name" (see blog of 17 January 2011 Companies House refuses to register NAC: "Offensive company name"). We have since assumed that the high profile US organisation Survivors Network of those Abused by Priests (SNAP) would be told by Companies House to change their name if they want the company incorporated in the UK.

This time round it has taken Companies House an entire week to inform Declan that when it comes to annual returns, the Head Office in Cardiff, Wales doesn't acknowledge receipt of documents filed on paper in their London office which are then delivered across the country to them by overnight van. This afternoon Declan's annual return was accepted and placed on the public record, but who's to say they could not have turned around come our deadline next Wednesday and say that they didn't have an annual return from us and therefore they are legally entitled to shut us down. What would happen then is even more concerning: the company Network for Church Monitoring would pass to the Crown because it doesn't have a legal owner, and if Declan wanted it back he would have to get a court order.

Are the police sending in the NHS medics?

Write an open letter to Prime Minister David Cameron enquiring if a warrant has been obtained for the property you live in - which the Home Office will neither confirm nor deny - and you could have one of the most notorious NHS psychiatric hospitals in the UK at your door! As Declan points out in his letter to the Prime Minister (published in the previous blog), neutralized MI5 whistleblower David Shayler, aka Delores Kane, lived for a couple of years in one of the rooms below us, until 2007 more or less.

I actually went down to the front door a little over an hour ago because I saw our live-in landlady, human rights activist Belinda McKenzie, by her car and thought it was her who was ringing our bell. Instead I found two women at the open door, both insistent that they needed to talk to Declan but wouldn't tell me who they were or what they needed to speak to Declan about, only that the police had sent them. In the end, one of them gave me a note and this is how I learnt that she was Dr Therese Shaw, consultant psychiatrist from St Ann's Hospital, and her companion a social worker called Kate Walsh.

St Ann's Hospital has a terrible reputation. In 2003 an inquest jury found that a man who died after being restrained by police there was unlawfully killed. And of course there is "Baby P", a 17-month old boy who died in London after suffering more than 50 injuries over an eight-month period. Three days before Baby P was killed, he was seen by a doctor at St Ann's. We don't know what they want to talk to Declan about, and we have absolutely no interest in finding out!

Property Warrant: Open Letter to the Prime Minister

Our live-in landlady, human rights activist Belinda McKenzie, has threatened us in writing with physical removal from our flat (she wrote on 6 January, "I may have to evict you with the help of my Polish builder") and removal of all services from tomorrow. We have been taking these threats extremely seriously and one of us is now always in the flat. Belinda's solicitors, Kidd Rapinet, have also served us with a notice requiring possession of the flat by 26 March - the particular notice landlords use when they have no complaints about their tenants but still want them out. If we have nowhere to go, then the solicitors will go to the courts and the bailiffs will remove us.

Belinda is not your usual 60+ landlady. I cannot list all the causes she is involved in, there are so many (see blog of 14 January for a photograph of Belinda speaking against child abuse in Trafalgar Square last June). She is active in groups dealing with issues as far-ranging as abuse in the church and anti-war activism, and has been involved with the Iranian community for more than 20 years; she is even described as a "noted philanthropist". Among her many causes, there is 9/11 itself: this is a popular YouTube video of a guy called Charlie Veitch and Belinda going at it recently. Small world! This is the same guy who in 2009 went to the trouble of inviting Shayler for dinner so he could make a YouTube video of him talking about being the Messiah.

Below is a video about the David Shayler affair the BBC's Panorama produced in 1998. A New Statesman article dated 11 September 2006 featuring Belinda and Shayler gives no indication that he believed he was the Messiah at that time; whilst a Daily Mail interview with Shayler explicitly shows he believed himself to be Jesus by June 2007. A part of his mind is well gone.... In 2009, he was photographed by the Daily Mail being unceremoniously evicted from a farmhouse by the bailiffs and police.

No sooner had Declan returned from the High Court after lodging the application above to have his case against Haringey Council reopened due to the sabotage of our post than we lost access to the internet. In fact every day for the last week we have lost home connectivity to the internet, some days multiple times - neutralized MI5 whistleblower David Shayler lived for a couple of years in one of the rooms below us, until 2007 more or less.

Given the opposition, we are creating an N4CM project for Kickstarter to raise funds to avoid being put back to the street. Our chairman Dr Stephen Mumford not only funds the N4CM website but has agreed to be our American account holder for Kickstarter. If Kickstarter rejects the project, we will run it on the N4CM website. This morning those charged with thwarting our efforts even deleted a graphic I uploaded to my account with TinyPic for the previous blog (ie, an email Declan received from Haringey Borough Commander Det Chief Supt Sandra Looby concerning our live-in landlady's written threat to have us physically removed from our flat with the help of her Polish builder):

Belinda McKenzie is a human rights activist and our live-in landlady. On Thursday we had the police in our flat following Belinda's written threat to withdraw all our services from 26 January and have us physically removed from our (roof) flat with the help of her Polish builder (crime reference no: 2800668/12). Declan has had to request separate 'sign on' times from the manager of our jobcentre, Highgate Jobcentre Plus, so that one of us can be in the flat from now on. The manager, Clodagh Hargadon, would only agree to split us on 26 January, meaning I may be forced off Jobseeker's Allowance and we will have to survive on almost nothing. This is the Polish builder who is going to help me pack my bags:

Not only has our live-in landlady, human rights activist Belinda McKenzie, threatened us in writing with physical removal from our flat and the termination of all our services on 26 January, but this afternoon we lost our wireless internet connection to the router in the room below us for the umpteenth time. Declan had intended waiting two weeks for his Open Letter to the Rt Hon Theresa May MP, Home Secretary (see previous blog), but has decided to send it now before things get any rougher:

Our landlady threatens us in writing with physical removal from our flat by her Polish builder

Last night Declan called into Holloway Police Station to press charges against our live-in landlady, human rights activist Belinda McKenzie, for threatening us in writing with physical assault. According to Constable Harvey (NI116), there is no threat in Belinda writing "I may have to evict you with the help of my Polish builder". We would find this less concerning had not MI5 whistleblower David Shayler lived in one of the rooms below us for a couple of years, until 2007 more or less (see previous blog for a stunning photo of Shayler aka Delores Kane in a squat).

Declan has written to our MP, Equalities Minister Lynne Featherstone, to request that she writes to Theresa May, Home Secretary, about his concerns. If she is unwilling to so, Declan will write an Open Letter to May on 23 January, three days before Belinda has threatened to remove all services from us. I wish to report my live-in landlady Belinda McKenzie of 83 Priory Gardens, Highgate, London N6 5QU for her written threat of today's date to have my wife and me physically removed from our (roof) flat with the help of her Polish builder, a criminal offence. I wish to press charges and request that this matter be investigated by the Metropolitan Police with the utmost urgency.

I intend filing a case in the Central London County Court against Ms McKenzie for harassment, intentional infliction of distress and denial of appropriate services. She has threatened the removal of all services by refusing to accept any rent from us from the 26th of this month: our tenancy agreement states that we pay rent “inclusive of all extraneous charges save telephone line”.

Agenda to put us back to the street?

Of the last five blogs I have posted, two of them have been about our home internet access. Since 3 November we (Declan and I) have either had our internet connection cut or have had bandwidth problems ranging from just about being able to go about our business to being 'squeezed' to death. We don't know what is going on because our live-in landlady, human rights activist Belinda McKenzie (see photo below), told me before Christmas that she had access to the internet and was aware we had none. We have no idea what we are looking at for internet access over the next 2/3 weeks, notwithstanding Belinda's backdated notice for us to vacate our flat by 26 January. This evening I emailed Belinda to let her know that it will not be possible for us to vacate in as little as 3 weeks time:

As Declan points out in paragraph 10 of his application to the European Court of Human Rights concerning the interception of our communications and directed surveillance, we are also not immune to having our bandwidths 'squeezed' in public libraries including in the British Library, the no.1 library in the UK. Open Letter to the Irish Prime Minister

This evening Declan received confirmation from the Irish Embassy in London that his application for a passport "will be processed in approximately 3 weeks". Nothing unusual in that, except that in Declan's case it has taken a complaint to the British Independent Police Complaints Commission (IPCC), two letters to the Irish Ambassador to Britain and this Open Letter to the Irish Prime Minister (the letter Declan refers to from the Papal Nuncio concerning the Irish Sisters of Mercy is archived here):

Never before has an Irish Prime Minister attacked the Vatican so virulently as Taoiseach Enda Kenny did last July, when he said: "The Cloyne report excavates the dysfunction, disconnection, elitism, the narcissism that dominate the culture of the Vatican to this day." As Ireland is a 90 per cent Catholic country, you might assume that there could be some political risk in so eviscerating the Holy See. Yet, says the Catholic Herald, Kenny was in fact playing to the gallery: his speech merely reflected the ferocious public anger at the Catholic Church.

I am prevented from sharing new articles on Facebook

In the last three weeks our website has had 28,841 absolute unique visitors, but it raises the question: how many unique visitors would we have had given half a shot? The Department for Work and Pensions are all out on the termination of our benefits (see the previous blog Mr Justice Mitting rules that Declan's claim is not "Totally without Merit"); our live-in landlady has given us backdated notice to vacate our flat by the end of January; our local housing authority, Haringey Council, has left us every month since July with a £77 shortfall in rent to pay (now a High Court case); and Facebook has restricted me since last August to my own wall and sharing my articles with private groups, the latter only because I have been added to these groups by Facebook friends. Not even a letter from Equalities Minister Lynne Featherstone has elicited a response from Facebook.

Now a very strange thing is happening: since yesterday afternoon the photo and text of my new articles are not showing when I share them in Facebook:

This anomaly also applies to our "About" page and Declan's petition to the UN in support of embryonic stem cell research which has been signed by no less than 28 Nobel laureates, 13 US National Medal of Science winners and seven UK Royal Medal winners, as well as hundreds of other scholars from around the world. It is an uphill struggle but both Declan and I believe that we are encountering nothing that money cannot solve: living and fighting on half our squalid benefits, we are no more than an easy target. With two months to go to vacate this property (that MI5 whistleblower David Shayler aka Delores Kane once lived in), we are left with no choice now but to focus on the development of our N4CM Survival Appeal Pledge Scheme to raise $35,000. Even this is a serious challenge: to get one email through to somebody in America, Declan regularly has to make one or two phone calls, and this despite his application last month to the European Court of Human Rights concerning the interception of his communications and directed surveillance.

Perhaps I should also add that I am prevented from submitting articles to Reddit. I have only ever submitted seven links, but every time I try to submit a new link I am told: "You've submitted too many links recently. Please try again in an hour." Just like Facebook, Reddit does not reply to my emails. I actually have some snags because frankly it is difficult to believe: from 16 November, 17 November, 20 November and 30 November. My articles are so good, I can't even submit them for other people to vote! Here is an article that has been shared 1,951 times on Facebook and was given 166 votes by Reddit users after somebody submitted it. Undoubtedly our site has massive potential. If only we had half a shot ...

Mr Justice Mitting rules that Declan's claim is not "Totally without Merit"

As I wrote in the previous blog Will we get the internet back?, Declan had an oral hearing in the High Court last Tuesday of his claim in person against our jobcentre, Highgate Jobcentre Plus, for discrimination and harassment - formally through A4E and currently through Reed in Partnership. Highgate Jobcentre Plus is part of the Department for Work and Pensions (DWP). Mr Justice Mitting refused permission to apply for Judicial Review, but ruled that the claim was not "Totally without Merit" as soon as Counsel representing the Secretary of State for Work and Pensions raised the issue of costs. The first thing I did when Declan obtained a copy of Counsel's note of hearing last week was to check that this ruling was there. It was.

This afternoon Declan filed his claim with the Court of Appeal. This is his Skeleton Argument (the Grounds of Appeal can be found here) - MI5 whistleblower David Shayler, who lived in one of the rooms below us for a couple of years, is mentioned in paragraph 25 (there is a stunning photograph of Shayler aka Delores Kane in the previous blog):

This appeal will apparently be quite a challenge. The "Judgment", which sets out the reasons the Judge gave for his decision, was recorded but when Declan asked the Judge for the transcript at public expense, he was told that if he wanted it he would have to pay for it himself (an impossibility). Last week DWP Legal Services refused to provide Declan with a note of judgment approved by the Judge because the hearing was recorded. This afternoon Declan sought to reapply for the transcript but was refused a receipt for the application by the Civil Appeals Office.

This raises the question: If the person appealing a High Court ruling is on state benefits and cannot afford the cost of the transcript of judgment, does this mean he loses his case because the Lord Justice cannot read and therefore cannot understand the reasons why the Judge reached his decision?

Declan was told by the Civil Appeals Office that if he didn't want to apply for the transcript of judgment without a receipt, he should deal with his case manager, as soon as he is allocated one. Surely he will not be told by this case manager that his claim can go no further because he cannot afford to pay for the transcript. It would certainly make for a very strange application to the European Court of Human Rights - from a High Court judge ruling that the claim is not "Totally without Merit" to the end of the domestic line with a case manager in the Civil Appeals Office!

Will we get the internet back?

Declan has an oral hearing in the High Court next Tuesday of his claim against our jobcentre, Highgate Jobcentre Plus, and as I showed in the previous blog We are removed from the internet ... this time no bandwidth, since 3 November our bandwidths have been frequently 'squeezed' to death. Declan started an IT course on 31 October and had to pull out last week because he couldn't use the online courseware. The last time we lost our home internet connection, we did so for six weeks commencing on 4 July, as Declan states in paragraph 9 of his skeleton argument for a High Court judge next Tuesday, which I published in the previous blog. This has now gone on for two weeks and is just one of the forms of harassment we deal with, as Declan makes clear in his application last month to the European Court of Human Rights regarding the interception of our communications and directed surveillance.

We are removed from the internet ... this time no bandwidth

Tomorrow Declan will lodge with the High Court his skeleton argument for his oral hearing on 22 November. He is looking for permission to apply for judicial review against our jobcentre, Highgate Jobcentre Plus. He argues an important point of principle or practice, namely, that he is provided with no remedy under welfare law for discriminatory practice by private sector providers of the Department for Work and Pensions' Work Programme. He will have just seven days to appeal to the Court of Appeal following the hearing but, given 132 breaches of contract by Action for Employment (A4E), we believe we are left with no option but to appeal.

You would think that the application Declan lodged last month with the European Court of Human Rights regarding the interception of our communications and directed surveillance might cut some ice, but not at all! The blogs I have written since have been designed to show that there has been no let up on any front, and now I can add no internet access to the mix. Since last Thursday, our bandwidth has been 'squeezed' to death. Yesterday it went the entire day. It seems we could well be back to the British Library, the no.1 library in the UK, to be 'squeezed' some more. Just as well we have plenty of work to do offline!

Highgate Jobcentre Plus will go for anything!

If we had any doubt that Highgate Jobcentre Plus is gunning to terminate our benefits, we need look no further than this afternoon. Declan's new IT course, which takes place on Mondays and Thursdays, was clashing with our 'sign on' at the Jobcentre this coming Thursday - we sign for Jobseeker's Allowance every second Thursday. It should have been pretty straightforward to have our sign times changed from 12.10pm to 4.00pm. But nothing is ever straightforward with the Jobcentre.

Senior Operations Manager Tia Ahmed doesn't change my time, but in changing Declan's from 12.10pm to 4.00pm, insisted on writing that his original appointment had been scheduled for 9.15am, meaning now I don't know whether I am supposed to turn up this Thursday at 9.15am or 12.10pm. Declan even went so far as to tear Ahmed's note up, but she still refused to rectify the error and told Declan to take the torn up paper with him. So tomorrow Declan will dispatch his first tier complaint to the manager of the Jobcentre, just in case I run into any problems when I turn up to sign at 12.10pm, as scheduled.

It never rains but it pours! When Declan got back to the flat on his own this evening, he opened the bathroom door and it came off its hinges! It was awkward for him because within two weeks of the dispatch last August of his application to the Investigatory Powers Tribunal (IPT) regarding the interception of our communications and directed surveillance, our live-in landlady, human rights activist Belinda McKenzie, served us with backdated notice to vacate our flat by the end of January.

Anyway, he says it was nothing on discovering in September 2010 that the four TV blow-outs we had had within the first ten months of our tenancy were due to make-shift and damaged wiring on the roof of the house, which although live could end up lying in pools of water in heavy rain.

Belinda's builder, a Polish guy who has been working on an underground extension in the garden for months now, came up and took the bathroom door away. Great!

Declan's first interview with Reed in Partnership

We hate coincidences! Within two weeks of Declan's dispatch last August of his application to the Investigatory Powers Tribunal (IPT) concerning the interception of our communications and directed surveillance, our live-in landlady, human rights activist Belinda McKenzie, served us with backdated notice to vacate our flat by the end of January and Haringey Council left us with our first £77 shortfall in rent to pay, among other things. This time, the day after Declan sent his application to the European Court of Human Rights (following the IPT's dismissal of his complaint), our jobcentre, Highgate Jobcentre Plus, issued letters notifying us that we were being placed with Reed in Partnership, a private-sector provider of the Department for Work and Pensions' Work Programme.

This afternoon Declan's adviser kept mentioning the "mandatory activities" Declan could expect from him in the weeks to come, without being specific about what he had in mind. All Declan could do is keep reminding the adviser and the manager who sat in on the interview that his first tier complaint would not be directed at Reed in Partnership but at Highgate Jobcentre Plus for sending us to an unsuitable provider, if and when a case can be made.

Suffice to say that we both remain deeply concerned that Highgate Jobcentre Plus has selected Reed in Partnership to use us as cheap labour for dead-end jobs. Declan will be raising this concern with a High Court judge next month in the matter of Heavey v Highgate Jobcentre Plus referred to in paragraph 17 of his application to the European Court of Human Rights. Application to the European Court of Human Rights

Yesterday Declan sent his application to the European Court of Human Rights (ECHR) regarding the interception of our communications and directed surveillance, having introduced the case to the Court on 5 September. As Declan writes in paragraph 20, within two weeks of the dispatch of his complaint to the Investigatory Powers Tribunal (IPT), dated 10 August, I had my Facebook account disabled; our IP address was twice blocked by our web host; our live-in landlady, human rights activist Belinda McKenzie, served us with backdated notice to vacate what has been our home since July 2009; and our local housing authority, Haringey Council, left us with our first £77 shortfall in rent to pay. Nonetheless, the IPT came back to us on 1 September, stating that Declan's complaint was “obviously unsustainable”.

There is no appeal from a decision of the IPT, leaving us with the ECHR and the Office of the United Nations High Commissioner for Human Rights. This is Declan's application to the ECHR:

This morning our jobcentre, Highgate Jobcentre Plus, came at us again, despite that Declan has them before a High Court judge next month. First an officer was keen for us to agree to let the jobcentre send our CVs to any employer of their choosing! Then we were issued letters staing that we are now being placed with Reed in Partnership, a private-sector provider of the Department for Work and Pensions' Work Programme. Declan wrote in paragraph 17 of the application above that we are deeply concerned about what lies in wait for us with the next provider.

No sooner will we have completed our first interviews with Reed in Partnership than we will turn on our skeleton argument for the High Court hearing, given the nightmare we were put through for a year with Action for Employment (A4E) and the blasé attitude Highgate Jobcentre Plus had towards all four of the formal complaints Declan lodged with the jobcentre alleging serious breaches of contract by A4E.

In October 2007 Declan wrote a petition to the United Nations regarding therapeutic cloning, known technically as 'somatic cell nuclear transfer' (or SCNT). We were living rough on the streets of London at that time - we were forced to live rough in central London for more than 2 1/2 years (see our About statement in the N4CM website) - but nonetheless 28 Nobel laureates and hundreds of scientists and scholars have signed the petition. It would have been signed by thousands if our emails were not getting lost in cyberspace or delivered to spam boxes (see paragraph 8 of Declan's application to the IPT). We believe the petition is more important than ever following the announcement last week that scientists in New York have used SCNT to create personalised embryonic stem cells in humans for the first time.

Prof Robin Lovell-Badge from the UK National Institute for Medical Research, who signed Declan's petition, said of the research published in the journal Nature: "This paper will be seen as significant both by those who are trying to use somatic cell nuclear transfer to produce human patient-specific embryonic stem cell lines and by those who oppose human 'cloning' experiments."

Our live-in landlady threatens illegal moves against us

This morning our live-in landlady, human rights activist Belinda McKenzie, put under our door a receipt for the rent I paid on 26 August for the previous month together with a note stating that next Thursday she was going to deal with Declan’s claim for housing benefit, without his authorization. (On 17 August Belinda served us with 6 months notice backdated almost a month, and last month Haringey Council left us with an unprecedented £77 shortfall in rent to pay out of the £211 we receive every two weeks in jobseeker’s allowance). Perhaps Belinda is just not aware, but this of course is an illegal practice which, if it were deemed acceptable by housing authorities, would leave recipients of housing benefit at the mercy of landlords. A landlord doesn’t like a tenant? No problem – all he has to do is ask the local housing authority to stop that tenant’s housing benefit! Declan wasted no time getting back to Belinda on this:

Belinda is not your usual landlord: apart from being involved with the Iranian community for more than 20 years, she is also active in the Stop the War Coalition, Hollie Demands Justice, and abuse in the Church, among other causes. She also had MI5 whistleblower David Shayler living in one of the rooms below us for a couple of years, until 2007 more or less. According to the BBC, Shayler "caused the biggest crisis of official secrecy since the spy catcher affair"; in 2002, he went to jail for seven weeks for breaking the Official Secrets Act. By around 2007, he was successfully neutralised: he changed his name to Delores Kane, declared himself to be Jesus, and became a squatter. A New Statesman article dated 11 September 2006 featuring Belinda and Shayler gives no indication that he believed he was the Messiah at that time; whilst a Daily Mail interview with Shayler explicitly shows that he believed himself to be Jesus by June 2007.

My IP is blocked by the web host for the third time

Within less than two weeks of Declan’s dispatch on 10 August of his application above to the Investigatory Powers Tribunal (IPT) regarding the interception of our communications and unlawful directed surveillance, our web host SiteGround twice blocked my IP address (see blog here) – in addition, within the same period, Facebook disabled my account (see blog here); our live-in landlady, human rights activist Belinda McKenzie, served us with five months notice to vacate what has been our home since 2009 (see blog here); and Haringey Council left us with an unprecedented £77 shortfall in rent to pay (see blog here). This afternoon SiteGround blocked my IP for the third time, meaning my browser wasn’t able to access the site at all.

As Declan wrote in paragraph 12 of his application to the IPT, our chairman, Dr Stephen Mumford, has been funding the N4CM website since December 2010, after the site was removed from the internet without explanation by Just Host, a web hosting provider we had paid for hosting until 2015. According to SiteGround this evening, there have been “a large number of simultaneous connections towards the server”, when in fact, as I informed them this afternoon, they have had me restricted to one tab for over two weeks:

It’s not just SiteGround. Facebook now threatens to permanently disable my account the next time I post on a Facebook page with similar interests (see blog here). Because of this threat, I have not been posting on Facebook pages with similar interests. Nonetheless, “Exposing religious fundamentalism in the US”, which I uploaded two days ago, has been shared around Facebook 102 times, but according to the Facebook widget they recommend to webmasters to let people know what postings are currently popular, it has been shared 70 times. “Goodbye to All That: Reflections of a GOP Operative Who Left the Cult” has been shared 115 times, but according to the Facebook widget, it has only been shared 85 times. And “Inside the Christian Right Dominionist Movement That’s Undermining Democracy”, which has been shared in Facebook 198 times, Facebook says has only been shared 43 times. So my work on N4CM has been decimated, Facebook is effectively barring me from posting on Facebook pages with similar interests, and now there would appear to be an attempt to make N4CM seem less popular than it is. What's next?

Introductory letter to the European Court of Human Rights

It was only on 10 August that Declan dispatched the application above to the Investigatory Powers Tribunal (IPT) regarding the interception of our communications and unlawful directed surveillance. However, on Saturday we received a letter from the Tribunal dismissing Declan's claim; and, for good measure, gratuitously insulting us too - by calling Declan's application "obviously unsustainable". The insult is particularly offensive because within two weeks of the dispatch of the application, Facebook disabled my account (see blog here); our web host, SiteGround, twice blocked my IP address (see blog here); our live-in landlady, human rights activist Belinda McKenzie, served us with five months notice to vacate what has been our home since 2009 (see blog here); and Haringey Council left us with an unprecedented £77 shortfall in rent to pay (see blog here). Now Facebook threatens to permanently disable my account the next time I post on a Facebook page with similar interests (see previous blog).

Perhaps this is just the IPT's way of going about their business - after all, as Declan points out in his introductory letter to the European Court of Human Rights below, the Tribunal has only ever upheld ten complaints since its inception in 2000. Declan also mentions a 2009 report from the New Internationalist headlined, with good evidence, "Police surveillance and intimidation of political activists in the UK is hitting new heights". The Guardian recently exposed that an 85-year-old peace campaigner has been classified by police as a "domestic extremist".

Anyway, Declan has wasted no time kicking off his case under Articles 8 (right to respect for private and family life and correspondence) and 13 (right to an effective remedy) of the European Convention on Human Rights:

Since Declan's dispatch on 10 August of the application above to the Investigatory Powers Tribunal (IPT) regarding the interception of our communications and unlawful directed surveillance, it hasn't stopped: Facebook has disabled my account (see blog here); our web host SiteGround has twice blocked my IP address (see blog here); our landlady, human rights activist Belinda McKenzie, has served us with five months notice to vacate what has been our home since 2009 (see blog here); and this morning Declan went to the bank to discover that Haringey Council has left us with an unprecedented £76.92 shortfall in rent to pay.

Perhaps £77 doesn't sound too much, but as Declan illustrates in paragraph 10 of his application to the IPT, there is a serious attempt to keep us impoverished and so we are surviving on the £211 we get every two weeks on Declan's joint claim for Jobseeker's Allowance. Declan has Haringey Council before the Tribunals Service (not the IPT) for these shortfalls in rent, which started last March. However, the Council doesn't seem to take a blind bit of notice. So this is Declan's latest to the Tribunals Service on the issue:

My IP is blocked by the web host for the second time in a week

Most certainly the Investigatory Powers Tribunal (IPT) website should warn citizens that if they decide to lodge a complaint against the Intelligence Services or a public authority they should expect things to happen. Declan sent his application to the IPT regarding the interception of our communications and unlawful directed surveillance on 10 August and since then I haven't stopped blogging: on 13 August, Facebook disabled my account without warning or cause and hasn't even bothered to reply to our emails (see previous blog Declan reports Facebook to the Investigatory Powers Tribunal); on 16 August, our web host blocked my IP address and I couldn't access our website or my files in the server (see blog here); on 17 August, our live-in landlady Belinda McKenzie, a human rights activist, served us with 5 months notice to vacate what has been our home since July 2009 (see blog here); and this afternoon SiteGround blocked my IP address for the second time in less than a week.

SiteGround has been hosting our site since December 2010 and has never blocked my IP until now so I was beginning to wonder if somebody had got a hold of my IP and established multiple connections to the server, resulting in their two blocks within days of each other. However, according to SiteGround, I should limit myself to one browser tab to do all my work in relation to the site (I previously always used two: one which contained my WordPress installation so I could publish articles, and a second to check my work), and Declan and I should no longer access the site at the same time, at least not until we have paid for an upgrade:

In our About page statement, I added last night that within one week of Declan’s application to the Investigatory Powers Tribunal (IPT) above regarding the interception of our communications and directed surveillance, our live-in landlady, human rights activist Belinda McKenzie, served us with backdated notice to vacate our home by the end of January (see previous blog). In fact, within that week Facebook disabled my account without warning or cause and SiteGround blocked my IP address, the latter of which prevented me from accessing our website for the first time since the web host began hosting the site back in December 2010. Although my IP address is now unblocked, Facebook has yet to get back to me or restore my account. We also have no idea who or what is next in the queue; but whomever or whatever it is, this afternoon Declan opened up a fast track to the IPT with Facebook:

Perhaps our jobcentre, Highgate Jobcentre Plus (of the Department for Work and Pensions), will be next. They have lined us up for a one-hour interview next Thursday to take a shot at our jobseekers agreements with the DWP, which we always far exceed. It is scheduled to take place prior to our 'sign on', a prerequisite to our receipt the following Tuesday of £211, the money we receive for the both of us every two weeks. We smell trouble. After all, it was the DWP that forced us to sleep rough on the streets of London for more than 2 1/2 years, from 3 November 2006 and 13 July 2009, because Declan didn’t 'sign on' TWO DAYS BEFORE he was due to do so on 29 September 2006 (see paragraph 10 of the application to the IPT above; paragraphs 2 and 3 give a bit of our background).

Within a week of Declan’s dispatch on 10 August of the complaint above to the Investigatory Powers Tribunal (IPT) regarding the interception of our communications and unlawful directed surveillance, Facebook has suspended my ability to post on FB Page walls (see blog of 13 August Facebook suspends my account and threatens termination); our web host’s firewall blocked my IP address, preventing me from accessing our website for the first time since they began hosting our site in December 2010 (see previous blog); and, to top the lot, today our live-in landlady Belinda McKenzie, a human rights activist, served us with five months notice to vacate what has been our home since July 2009 (although Belinda cites six months here, it accompanies a tenancy agreement that has been backdated to 26 July, when our previous one-year agreement expired):

This is not all. This morning Declan took a trip to the bank to discover that Haringey Council will be leaving us with an unprecedented £76.92 shortfall in rent to pay this month, despite that Declan has them before the Tribunals Service (the latest from the Clerk to the Tribunal is archived here). The only bit of good news in all this is that after I emailed our live-in landlady Belinda McKenzie to remind her again that she has to give us a new rental agreement (the last one ran out on 26 July), she emailed me back saying she was on it. Well, hopefully this is good news!

Facebook suspends my account and threatens termination

When I put a link in our About page to Declan’s complaint on Wednesday to the Investigative Powers Tribunal (IPT) regarding the interception of our communications and unlawful directed surveillance (see previous blog), little did I know that three days later I would be adding Facebook to the paragraph. Without cause or warning, Facebook has informed me this evening that I have been posting spam and irrelevant content on FB Pages and therefore my ability to post on Page walls has been suspended for 15 days. They add that if I continue to post 'spam' after this block has been lifted, my account could be permanently disabled.

For a start, I have hardly been on Facebook of late because we lost our home internet connection for over a month. Since 4 July through to today, whenever I have accessed Facebook, it has only been for a few minutes at a time and only to keep my wall and the N4CM wall ticking over. Moreover, I only post on Page walls articles I publish on our site – for example, on Thursday I posted Church Shaken by Sexual Abuse Allegations in Africa, which has been recommended by 393 people – and never to friends' walls but to relevant groups and organisations. Seconds before Facebook took me out, I posted The Hungry Planet: Global Food Scarcity in the 21st Century to the US organisation Population Connection. What spam and irrelevant content?

It also turns out that we were right to be concerned about our 'sign on' last Thursday in our jobcentre, Highgate Jobcentre Plus. They have lined us up for a one hour interview on Thursday week to take another shot at our contractual agreements with the Department for Work and Pensions, which we have always far exceeded. Between one thing and another, we have decided that on Monday we are kicking off our fundraising campaign by sending a Letter of Inquiry to philanthropic foundations for a general support grant. We have no choice really, if we don't want to be put back on the street. It never rains but it pours.

Application to the Investigatory Powers Tribunal

In the previous blog, I published a statement that Action for Employment (A4E) faxed last week to our jobcentre, Highgate Jobcentre Plus, alleging that Declan "has constantly been uncooperative, blaming others for his reasons for not finding employment". The week previous, my A4E adviser didn’t see it that way, writing on 26 July that Declan and I intended lodging a complaint with the Investigatory Powers Tribunal regarding the interception of our communications and unlawful directed surveillance. There is not one single application to the IPT online, but this is the second of two applications Declan submitted to the Tribunal this morning (the Human Rights Claim Form, Form T1, asks much the same questions):

The IPT was established in 2000 to investigate complaints about surveillance by the Intelligence Services and public authorities. The New Internationalist pointed out in 2009 that police surveillance and intimidation of political activists in the UK had hit new heights. Nonetheless, since its inception, the IPT has only ever upheld ten complaints. We are not naive enough to think that Declan's complaint will be upheld, and this side of an application to the European Court of Human Rights we have no choice but to make ours public so concerned are we about Highgate Jobcentre Plus, and our 'sign on' in the Jobcentre tomorrow in particular. At least tomorrow we will have this application and the e-letter I published in the previous blog to our MP about A4E behind us, with Declan's renewal hearing in the High Court against the Jobcentre scheduled for 22 November (see blog of 14 April Declan's Notice of Renewal of claim for permission to apply for Judicial Review).

A4E advisor's additional comment on Declan's 1/8/2011 Action Plan on Exit:

"Mr Heavey has failed to attend interviews set up for him by his advisor and has constantly been uncooperative, blaming others for his reasons for not finding employment."

Declan advised his A4E Advisor Lola Olowu-Worth that the Action Plan on Exit she submitted to our jobcentre this morning (without his signature) is actionable for fraudulent misrepresentation.

As has been the case every two weeks for more than two months now, tomorrow we have no idea whether there will be any money in the bank for us or, if there is, whether there will be anything there for us in two weeks time. Highgate Jobcentre Plus has twice sanctioned Declan without affording him the opportunity to present evidence of good cause to the Decision Maker, so he delivered this e-letter to the manager of the Jobcentre this afternoon (the letter mentioned to the Prime Minister is archived here):

Fortunately for us, Declan and I have plenty of evidence that points to the fact that we are not to blame for all the problems that seem to follow us everywhere we go. Well, as my own advisor wrote a few days ago in my Action Plan on Exit: “Mrs Heavey alleges unlawful directed surveillance and unlawful interception of communications by MI5 and the Government Communications Headquarters (GCHQ). She is filing tomorrow 27/7/11 a complaint to that effect with the Investigatory Powers Tribunal as advised by the Home Office and her MP Lynne Featherstone.” We haven't finished the complaint yet because we haven't found one single complaint published online. We will, however, be publishing ours online. We have no choice - after Olowu-Worth's fax to our jobcentre!

Action for Employment (A4E) is a private company founded and chaired by Emma Harrison CBE that controls 25% of the long-term unemployment budget for the Department for Work and Pensions (DWP). The first time Declan's highly abusive A4E Advisor Lola Olowu-Worth raised a sanction doubt against him, our housing benefit was suspended without warning or explanation (see blog of 8 June DWP instructed Haringey Council to stop paying our rent). On that occasion it was because Declan would not agree to be trained as a warehouse operative; yesterday Olowu-Worth cancelled a “progress review” without notification, but had previously told him that if he failed to turn up to an unagreed telesales interview that she had brazenly gone ahead and re-arranged for him last week that she would raise a fourth sanction doubt against him. Our live-in landlady, activist Belinda McKenzie, has two accounts with different providers and three access points. Our access point “Guest” (situated in one of the rooms below us) is not responding to our laptops and when I occasionally get connected on “moj” (situated in the basement), I am disconnected pretty quickly. This week we also learnt by private email from a Nobel laureate that select emails of ours are still being delivered to spam boxes (see blog of 20 June 2010 Interception of communications: Our MP responds). Belinda is a human rights activist who is involved in many causes, including Stop the War Coalition, Iranian solidarity, Hollie Demands Justice, and abuse in the Church. I keep joking that I should ask Belinda for some tips on how to avoid the interest of the secretive National Public Order Intelligence Unit (NPOIU) because, according to a recent Guardian article Peace campaigner, 85, classified by police as 'domestic extremist', it doesn’t take much to grab their attention! The High Court dismisses Declan's complaint for maladministration

In Monday’s blog A4E raises a third 'sanction doubt' against Declan, I mentioned that Declan had made a complaint against the Administrative Court Office of the High Court for their handling of his case against our jobcentre, Highgate Jobcentre Plus (see blog of 14 April Declan's Notice of Renewal of claim for permission to apply for Judicial Review). Well, little did we know that the Court Manager, David Brupbacher, would kick the dismissal of the complaint up to Her Majesty’s Courts Service (HMCS) Complaint Handling and Enquiries Team, leaving only the Parliamentary and Health Service Ombudsman to investigate:

A4E raises a third 'sanction doubt' against Declan

Action for Employment (A4E) is a private company that has received £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions (see the video in the previous blog A4E raises a second 'sanction doubt' against Declan). Our one-year lease is up for renewal in three weeks time and it would appear that the DWP have the A4E office we were allocated some time ago under particularly strong pressure to make it as easy as possible for our jobcentre to terminate our benefits. This includes making false statements against Declan, to such an extent that last Friday he was forced to report his highly abusive A4E Advisor Lola Olowu-Worth to the police:

"I wish to report my Camden A4E Advisor Lola Olowu-Worth for engaging in conduct which I believe to be criminal, involving racial discrimination. This afternoon Ms Olowu-Worth has written of her intention to raise a third sanction doubt against me with my jobcentre, Highgate Jobcentre Plus, based on a document she has drawn up which, among other things, falsely reports my views. When I informed Ms Olowu-Worth that she is engaging in what I believe to be criminal conduct by falsely reporting my views (like I was an Irish Mick), she replied: 'Good luck with that!' I request that this matter be investigated by the Metropolitan Police and that I be afforded the opportunity to adduce into evidence my e-letter this evening to my MP, Ms Lynne Featherstone."

The fact of the matter is that we are surviving here week by week. If Declan wasn't prepared to make complaints and lodge documents in the courts, as I keep registering in this blog, we would have been back to the street a long time ago. See here, for example, his latest complaint against the Administrative Court Office of the High Court for their handling of his case against our jobcentre, Highgate Jobcentre Plus; and here for his latest recording with the Tribunals Service of the payment of our rent by Haringey Council. Declan also has Highgate Jobcentre Plus in the Central London County Court, and last Friday registered with that court a request for judgment.

To top it all, we lost our internet connection again today and have no idea when or if we will get it back (see blog of 23 May Are we back to being 'squeezed' in public libraries?). This afternoon Olowu-Worth was as outrageous as ever (breaching Declan's contract with A4E no less than 12 times within 30 minutes), but the situation now is simple. Legally our jobcentre, Highgate Jobcentre Plus, must ask Declan for his answer to this latest sanction doubt raised by Olowu-Worth, but his views were never sought the last time. So Declan has upped the ante once again with this email just now to our MP, Lynne Featherstone, who also happens to be the Minister for Equalities:

We are still waiting to hear from the List Office in the High Court with a date for the hearing of Declan's case against Highgate Jobcentre Plus (see blog of 14 April Declan's Notice of Renewal of claim for permission to apply for Judicial Review). Declan is challenging the lack of remedy under welfare law for discriminatory practice by A4E. However, according to the Administrative Court Office, his application for expedition last December has expired, and there's no telling when a date will be set for his renewal hearing. Declan's latest to the court manager of the ACO about this earlier this week was copied to Lord Chancellor and Secretary of State for Justice Kenneth Clarke.

Suffice to say we have absolutely no way of knowing whether there will be any money in our building society for Declan to withdraw next Tuesday (a first), his complaint pursuant to Stage 1 of the DWP's complaints procedure over the interruption to our housing benefit payments notwithstanding. I will, therefore, work hard this weekend on our homepage just in case, featuring in the middle column Gordon Brown's Jobs + Justice campaign, a call on the G20 leaders to launch a global green jobs and stimulus plan to lift millions out of poverty. That will leave me with Monday to work on Declan's draft of our first grant request to a foundation.

DWP instructed Haringey Council to stop paying our rent

This is only a short update to yesterday's blog Haringey Council has stopped paying our rent?, which contains a stunning photograph of MI5 whistleblower David Shayler, who lived for a couple of years in one of the rooms below us. It turns out that indeed Haringey Council had stopped paying our rent. This morning Declan had no sooner mailed his latest judicial review letter before claim when he received a phone call and then an email from Haringey Council about the shenanigans. Apparently, the Department for Work and Pensions notified them that our Income Support was due to be terminated today but then that it had been reinstated (all unknown to us, and without explanation):

This evening Declan dispatched his subject access request under the Data Protection Act 1998 requesting the DWP's notifications. And this after we were forced by the DWP to sleep rough on the streets of London for more than 2 1/2 years because Declan did not "sign on" TWO DAYS BEFORE he was due to do so on 29 September 2006 (see About us). No doubt Shayler has a story or two about Haringey Council. According to the BBC's Panorama programme, Shayler “caused the biggest crisis of official secrecy since the spy catcher affair”. Haringey Council has stopped paying our rent?

Even though we have developed eyes on the back of our heads, we didn't see Haringey Council coming in the sense that Declan did not expect to call into our building society today to discover there was no rent there to withdraw. Some time ago, the Council came up with the idea of paying us by the week rather than by the month. What that means to anybody who pays rent by the month is that the payments leave them with a shortfall in rent to pay. This is Haringey's letter to Declan last week informing him that his appeal has been sent, at his request, to the Tribunals Service - nowhere in this letter does it state that his housing benefit payments have been stopped:

Declan will have no difficulty writing another letter before claim tomorrow, once again copied to the Leader of Haringey Council, Councillor Claire Kober, and is well on track to have his case filed in the High Court before our rent is due on the 26th of this month. Department for Work Pensions's threat to terminate our benefits on 8 June is very real

Last month the DWP threatened us by letter with the termination of our benefits on 8 June without an explanation (see blog of 18 May Department for Work and Pensions threatens to terminate our benefits on 8 June). Then, on cue, two days later A4E raised a "sanction doubt" on Declan's joint claim for Jobseeker's Allowance because he did not attend an unagreed 'work boost' - 30 hours per week of unpaid work for four weeks - at Booker Cash and Carry, to be trained as a warehouse operative! Today Declan was told he was expected to sit a basic maths test on Monday to be put forward for job vacancies in WH Smiths, the British newspapers, books and stationery retailer.

The situation now is simple: legally our jobcentre, Highgate Jobcentre Plus, must ask Declan for his answer to A4E's sanction doubt before 8 June, but Declan has already experienced a sanction by the Jobcentre without his views being sought (see blog of 20 May Central London County Court refuses to commit to taking Declan's case against Highgate Jobcentre Plus). So Declan has upped the ante with this email to our MP, Lynne Featherstone, who also happens to be a minister in the Home Office (the letter from Featherstone that Declan refers to in the first paragraph is published here):

All 54 breaches of contract cited in Declan's email above occurred right under the nose of Harrison, which can only mean she is fully behind them. Are we back to being 'squeezed' in public libraries?

We are back having problems publishing pages on our website! The last time this happened, in February, the Network for Church Monitoring site was brought down as Declan was about to publish our first book excerpt from a Nobel Prize winner (see blog of 8 February Website brought down as we are about to publish our first book excerpt from a Nobel Prize winner). This time, our internet connection is so slow I can't put the finishing touches to a fascinating interview with Nobel Laureate Paul Samuelson, by Distinguished Prof William Barnett, from Macroeconomic Dynamics, Volume 8:4, pp 519-542, 2004.

Prof Samuelson, who died in 2009 at the age of 94, has been described by the New York Times as "the foremost academic economist of the 20th century". The interview I am working on is more than 20 pages long and has taken a lot of work, but has been well worth it. Prof Samuelson is more relevant today than ever, if that is possible. In this video, he talks about Wall Street needing regulation, monitoring, and punishing:

Central London County Court refuses to commit to taking Declan's case against Highgate Jobcentre Plus

At least this morning the Central London County Court took Declan's case against our jobcentre, Highgate Jobcentre Plus, under the Data Protection Act 1998 (see blog of 26 April Central London County Court refuses to take Declan's case against Highgate Jobcentre Plus). However, they still have to decide whether they will process it and Declan had to come away with an unsealed copy of the papers he attempted to have filed.

Meanwhile, Declan is still waiting to hear from the List Office in the High Court with a date for the hearing of his case against Highgate Jobcentre Plus pursuant to the Jobseeker's Act 1995 (see blog of 14 April Declan's Notice of Renewal of claim for permission to apply for Judicial Review). Moreover, next week he will be filing another case in the High Court against Haringey Council (his Letter before Claim can be read here; they continue to deduct monies from our rent allowance with apparently no end in sight). And of course the Department for Work and Pensions has threatened to terminate our benefits in three weeks time (see previous blog Department for Work and Pensions threatens to terminate our benefits on 8 June).

On the flip side of all this, we now have a chairman registered in Companies House! Dr Stephen Mumford is the founder and president of the US-based Center for Research on Population and Security. He has been called to provide expert testimony before Congress on the implications of world population growth. Dr Mumford has in fact been funding our Network for Church Monitoring website since last December, after it was removed from the Internet by our former web host Just Host (see About us). Suffice to say that Declan has long considered Dr Mumford his mentor.

Last month the Central London County Court refused to take Declan's case against our jobcentre under the Data Protection Act because the Court Manager considered proofs that were good enough for the High Court insufficient for her court (see blog of 26 April Central London County Court refuses to take Declan's case against Highgate Jobcentre Plus). Declan had to write twice to an office in Glasgow to obtain the proof she specified and only today did he receive it, except that it states our benefits are only guaranteed until 8 June.

Tomorrow Declan will write back to this office in Glasgow requesting a written statement of reasons for the manager's decision, since we have not received one, and on Friday he will again attempt to file his case against Highgate Jobcentre Plus in the Central London County Court. Also today Declan received a letter from our MP, Lynne Featherstone, who is a minister in the Home Office, concerning A4E (see previous blog A4E asks Declan to sign for an unrevealed 'work boost').

We are not expecting any results in our favour: when Declan wrote to Featherstone more than a year ago regarding the interception of our emails, she said that she would try to prompt a response from the Home Secretary (see blog of 20 June 2010 Interception of communications: Our MP responds); only a few weeks ago she recommended that Declan finds himself a solicitor (see blog of 26 March Interception of emails: Home Office minister advises Declan to find himself a solicitor)!

A4E asks Declan to sign for an unrevealed 'work boost'

Declan's A4E's employment officer is Lola Olowu-Worth. In my blog of 9 April A4E: David Blunkett MP replies, I wrote that Olowu-Worth is exceptionally abusive, and described by Declan as singularly the most abusive person he has ever come across in an office (a "pseudo-bully").

Well, yesterday Olowu-Worth surpassed even herself. Not only did she breach contract five times in less than twenty minutes, but when Declan informed her that she was engaging in a criminal act by falsely reporting his views in his "Journey Plan", she responded that she knew the name of a criminal lawyer if he thought it would help. Then she wanted Declan to sign the document, thereby agreeing to start an unrevealed 'work boost' in a week! Outraged, Declan wrote this letter yesterday to our MP, Lynne Featherstone, who also happens to be a minister of the Home Office:

Olowu-Worth hasn't in fact given Declan one week to find his own 'work boost' (30 hours of unpaid work for four weeks), but three days: today is a holiday for the royal wedding and Monday a Bank Holiday. Indeed she has surpassed even herself!

The People's Supermarket finally let us go!

Action for Employment (A4E) is a private company that has received £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions. Today was the last day of a one-month A4E 'work placement' - 16 hours a week of unpaid work - for Declan and me at The People's Supermarket (TPS). We couldn't wait for the month to end, and we learnt absolutely nothing, apart from getting to know the various bus routes to and from Westminster Reference Library because we were given no access to computers at TPS. Neither TPS nor A4E reimbursed our travel expenses for the month, and we even had to use our own printer. Despite that the supermarket cooks ready meals (co-founder Arthur Potts Dawson is a celebrity chef), I wouldn't be able to comment on its tastiness because we were never offered any food.

We were supposed to be involved in a project delivering volunteer opportunities to clients of the Medical Foundation for the Care of Victims of Torture (MF), but TPS had other plans. I wasn't there a few hours when I was told to put on a yellow t-shirt and come to the shop floor as soon as I had five minutes of free time; she even told me to "shut up" when I protested. We also have an email from a member of staff telling us that we should put in time on the shop floor so we would be able to empathize with clients of MF (see the email I wrote to TPS near the end of this 'work placement' in the blog of 23 April 'Work Boost' at The People's Supermarket? I don't think so!). The agenda to have us working on the shop floor was so obvious that for the first two weeks I had to sit at the end of a couch in the members' common area while I worked on creating a volunteer leaflet for TPS. Frankly, it was some achievement that for the entire month we managed to stay off the shop floor.

A4E are under tremendous pressure to ensure that at the very least they send Declan back to our jobcentre with any sort of work experience on the shop floor of TPS so that Highgate Jobcentre Plus can then run a number on his jobseeker's agreement: a job in a supermarket such as Tesco, Sainsbury's or Morrisons would be just the ticket to not only have us out of our home and ready to be fired at the drop of a hat, but more significantly, see us back to the street. So A4E Camden have threatened they will issue a sanction letter against Declan tomorrow if he doesn't agree to his one-month 'work boost' - 30 hours a week of unpaid work - at TPS. At the hearing of Declan's renewed application for permission to apply for Judicial Review (see blog of 14 April Declan's Notice of Renewal of claim for permission to apply for Judicial Review), he will be arguing that A4E is engaging in an escalating series of harassing and discriminatory acts (see blog of 15 April Declan back to Lynne Featherstone MP with A4E's 14th breach of contract).

Just before leaving TPS, I asked co-founder Kate Bull to help us to stop the suspension of our benefits by getting in contact with A4E Camden Placement Advisor, Lola Olowu-Worth (who also happens to be Declan's employment officer) to tell her that she didn't need either of us to do our one-month 'work boost' at TPS. She was very reluctant about writing that and in the end she walked away from me saying that she wasn't going to tell me what she was going to write. Central London County Court refuses to take Declan's case against Highgate Jobcentre Plus

This morning the Court Manager of the Central London County Court prevented Declan from lodging his case against Highgate Jobcentre Plus under the Data Protection Act because she deemed the evidence he adduced with his application for a fee remission to be insufficient. When Declan told her that he never encountered such a problem in the High Court (see blog of Declan's Notice of Renewal of claim for permission to apply for Judicial Review), she told him, "This is not the High Court". 'Work Boost' at The People's Supermarket? I don't think so!

Action for Employment (A4E) is a private company that has received £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions. As I explained in the previous blog Declan back to Lynne Featherstone MP with A4E's 14th breach of contract, we have been on an A4E 'work placement' - 16 hours a week of unpaid work - at The People's Supermarket (TPS), which has been championed by Prime Minister David Cameron as an example of how his "Big Society" can work. A4E are under tremendous pressure to ensure that they send Declan back to our jobcentre with any sort of work experience on the shop floor of TPS so that the jobcentre can then run a number on his jobseeker's agreement: a job in a supermarket such as Tesco, Sainsbury's or Morrisons would be just the ticket to not only have us out of our home and ready to be fired at the drop of a hat, but more significantly, see us back to the street!

So far we have managed not to set foot on the shop floor, and neither of us have any intention of doing our 'work boost' - a mandatory one month of unpaid work at 30 hours per week - at TPS when this placement finishes next week. A4E threaten they will issue a sanction letter against Declan if he doesn't agree to his 'work boost' at TPS, but if our jobcentre, Highgate Jobcentre Plus, take our benefits, they will have to argue at the hearing of Declan's renewed application for permission to apply for Judicial Review (see blog of 14 April Declan's Notice of Renewal of claim for permission to apply for Judicial Review) that they are not discriminating against us and that in fact they regularly force claimants – with similar levels of education, skill and achievement – to undergo a ‘work boost’ at TPS and the like. This is my email to TPS yesterday, in which I flaunt the Metropolitan Police's secretive National Public Order Intelligence Unit (NPOIU):

Below is a video clip of Tory Employment Minister Chris Grayling talking about a new "revolutionary" work programme to put people who are claiming incapacity benefit back to work with the help of private contractors, the largest of which is A4E. What people should be made aware of is that the only revolution taking place here is that these private companies are not subject to the provisions of Jobseeker's Act 1995, according to John Howell QC (sitting as a Deputy High Court Judge), who dismissed Declan's initial application for permission to apply for Judicial Review (the Judge's reasons can be read here). What it means is that for so long as these companies don't issue a sanction letter, they can do just about anything they want and the claimant has no remedy under welfare law - we have had the tampering and altering of documents; the unauthorised and unlawful recording of meetings; the denial of the right to reply to outrageous written statements against us; and much more besides (see previous blog). Grayling's "Back to Work Support" will allow for unimaginable abuses.

The DWP must have them under serious pressure because despite Declan now writing to our MP, Lynne Featherstone, who also happens to be a minister in the Home Office, this morning it was the 14th breach of contract by A4E Camden in less than 7 months! So he has been back to Featherstone again this afternoon (Featherstone is quite familiar with Declan and only a couple of weeks ago wrote him another letter regarding the unlawful interception of our emails, see blog of 26 March Interception of emails: Home Office minister advises Declan to find himself a solicitor):

As the email shows, Declan and I have been on an A4E 'work placement' since 4 April at The People's Supermarket (TPS), which has been at the centre of David Cameron’s “Big Society” programme. We are there until 29 April to provide long-term volunteering opportunities for clients of Write to Life run by the Medical Foundation for the Care of Victims of Torture. TPS is the brainchild of celebrity chef Arthur Potts Dawson, a nephew of Mick Jagger. To keep prices and running costs low, much of what is needed to run TPS is provided by members and volunteers.

The Medical Foundation for the Care of Victims of Torture is a high profile charity. Their chief executive is former Tory MP, Keith Best. According to their 2009-2010 Annual Report, they received 55 legacies from supporters, generating nearly £900,000, as well as "generous support" from a range of Trusts, Foundations and grant-makers. Donations from individuals provide the core income for their work. In 2008, individuals contributed £4,785,167 towards a total income of £7,382,119.

Declan's Notice of Renewal of claim for permission to apply for Judicial Review

We have just discovered that the graphic of Declan's Notice of Renewal of claim for permission to apply for Judicial Review, which we were providing a link to in the previous blog, has been deleted. Nothing new in that (see blog of 12 September 2010 NAC blog is hijacked and vandalised).

Well, here is the Order of John Howell QC (sitting as a Deputy High Court Judge) refusing Declan permission to apply for a judicial review because in his opinion Action for Employment (A4E) are not subject to the provisions of the Jobseeker's Act 1995:

The List Office now has to arrange a date for the renewal hearing. Usually the date for a renewal hearing is communicated to the claimant within 8 weeks of the Administrative Court Office's receipt of an application for renewal. Declan has been informed by the Office that if he is not contacted within the next 6 weeks, he should take the matter up with the List Office directly.

Yesterday Declan’s A4E Camden employment officer, Lola Worth, refused him his right to have his "view" typed into his "Journey Plan" and then tampered and altered what she asked him to sign – Worth is exceptionally abusive, in fact Declan says she is singularly the most abusive person he has ever come across in an office (a "pseudo-bully"), and she has a lengthy track record of breaching Declan’s contract, so neither he nor I can say that we were at all surprised with this latest skulduggery. Of the 12 breaches cited here, Worth is directly or indirectly responsible for no less than 8 (Emma Harrison CBE is the founder and Chairman of A4E, and has had every single breach brought to her attention at the time of infraction):

The next time A4E hands one of us an outrageous Journey Plan without the right of reply, it is going, unsigned, straight into a bag to be produced in court. Interception of emails: Home Office minister advises Declan to find himself a solicitor

In February Declan received his third letter from our MP, Lynne Featherstone, a minister in the Home Office, regarding the interception of our emails. Initially she said she would try to prompt a response into why we are encountering these problems (see blog of 20 June 2010 Interception of communications: Our MP responds). Almost a year later, she is recommending that Declan finds himself a solicitor. What she appears to be saying, however, is that the Home Secretary hasn't issued a warrant and that the on-going interception and manipulation of our email - this week we received undelivered emails in our spam box! - is unauthorised and unlawful:

This is particularly concerning because last Saturday I uploaded a statement to our website for President Obama and members of Congress about forest funding and we are seeking the endorsement of scientists and economists from around the world. In light of our on-going difficulties with email, we believe that our only chance of success is to aim for the endorsement of 30 or 40 leading experts in the field of climate change, and to get through to as many as we can by email with use of the phone. Declan's petition to the United Nations regarding therapeutic cloning has been signed by no less than 28 Nobel Laureates as well as hundreds of other distinguished scholars, but it took years and the manipulation of email got so bad that last April Declan had to shelve it (see blog of 20 January, A4E refuse me a Journey Plan, which contains an open letter from a distinguished American professor who last April was "truly appalled by the unlawful violation of the Heaveys' basic right to send and receive email without interference").

Another reason why we can't send personalised emails in their hundreds is because there is a high probability we would lose our website. In 2008, we lost our original site due to a Spamcop report that was drawn up the day after the Home Office denied that a warrant had been issued to intercept our communications (see blog of 14 March 2008 SpamCop reports Declan as a spammer). Only last month, I titled a blog Website brought down as we are about to publish our first book excerpt from a Nobel Prize winner, so somebody is trigger happy!

Every time we have to attend an interview in A4E Camden, more or less every two weeks, there is some outrageous play - even though Declan has been constantly writing by email and registered post to A4E founder and chairman, Emma Harrison CBE. This is Declan's email today to the regional director of A4E for the south of England, copied to Harrison (he will be writing a full-blown letter to Harrison tomorrow under the Jobseeker's Act 1995, copied to several people in the Department for Work and Pensions, including the Secretary of State for Work and Pensions):

I have now been assigned a new employment officer and even before my first interview with Sophie Nzegwu, she was setting me up to lose my benefits: it is actually a mystery how this letter of hers calling me to an interview arrived in the post at all (my post code is N6 5QU, not N19 3BX):

Declan has a busy time of it tomorrow. On top of having to write to Harrison, he also has to fit in writing to the Leader of Haringey Council, Cllr Claire Kober. The Council claimed earlier this month that they had overpaid our housing benefit by £130 and, despite that Declan sent them documentation proving this claim to be false, on Tuesday we discovered they had unceremoniously docked us £30 - quite a hit in the circumstances. In February 2010, Kober wrote to Declan, stating: "I was sorry to read of the problems you have incurred in trying to claim Housing Benefit. I have asked that the complaints team send me a copy of their response and hope that this matter is soon resolved."

Declan is well used to relentless harassment and is completely unfazed by this latest escalation (for more on the different kinds of harassment we have been weathering, see the About us page in the MonChurch website, which includes a no-nonsense video of Declan taking on A4E outside an office of theirs last September).

My A4E advisor accuses me of racial abuse

This afternoon my A4E Camden employment officer, Greg Janiszek, accused me of racial abuse and told me he would find a member of staff to corroborate his allegation - Janiszek has created a four-page track record under my name and behind my back which is slanderous and inaccurate and has tampered and alerted a document I signed back in September, so it's not like I am all that surprised. This is Declan back to the founder and chairman of this company, Emma Harrison CBE:

Of all the exhibits we have collected on this company since we started up with them in July, this has to be one of the most absurd:

My statement for PC EK7109 of Kentish Town Police Station:

"This afternoon I had an interview with my A4E Camden employment officer, Greg Janiszek. During the interview Janiszek accused me of offending him and claimed I had called him 'Pollack' and 'thick'. He said he was sure he would be able to find another member of staff to corroborate my use of these two words. His accusation took place after he kept asking me over and over again why I didn't attend a Terrence Higgins Trust workshop on 26 February regarding my intention to volunteer for them for a few hours a week. I totally refuted his allegation of racial abuse and told him he had no credibility whatsoever in the context of my husband's High Court action involving A4E. To this he responded 'uh' (as in 'really?') and grinned."

It was PC EK7109's opinion that the police wouldn't be coming to our flat any day soon to arrest me!

Declan is also waiting to hear from Mr Justice Sycamore of the High Court (see blog of 3 December 2010 By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review). Yesterday the Court informed Declan that papers went to a judge on 21 February, so we ought to be hearing from one any day now. We have actually been writing to Harrison since last August, week in, week out, about one thing after another. Little did we know when we started up with this company that we would be dealing with so much skulduggery.

A4E cost Declan a major opportunity with the Terrence Higgins Trust

With the exception of one blog on the bringing down of our website, all my blogs this month have been about Action for Employment (A4E), and this trend seems set to continue. Yesterday Declan came home to a letter from A4E Camden informing him that he is to take part in a "work boost", which is basically a mandatory four-week period of unpaid full-time work. So four days before we are due to be interviewed for voluntary work by the Terrence Higgins Trust (THT), the leading HIV & AIDS charity in the UK and the largest in Europe, Declan is forced to withdraw his name.

This is quite startling because Declan and his employment advisor, A4E Camden manager David Lawson, signed a My Journey Plan on 19 January which states that Declan would complete his work boost in April upon completion of an IT course he is currently taking at WMC, a premier adult education college. Declan volunteering for the THT was a huge opportunity to make sure his work boost would take place in a premier non-profit organisation, thereby increasing his chances of securing sustainable employment.

An A4E booklet states: "Together with your Employment Coach, you'll decide when and where the best place to take your Work Boost will be" (emphasis mine), but this doesn't seem to apply to Declan. In fact, we have yet to come across anything A4E states that does apply to him (in the previous blog I list five breaches of contract since 29 September, which include the tampering and altering of documents both Declan and I have signed; this blog also contains a video of Declan taking on A4E outside our a branch of theirs that had him escorted from the building by the police the week previous).

This letter from Lawson (archived here) also announces that Lawson himself is no longer Declan's employment advisor, but Placement Advisor Lola Worth, the very woman I wrote about in the previous blog for insisting, without knowing anything about Declan's CV or our website (or so she says), that Declan do his work boost in a supermarket or a warehouse (the only two options she put on the table). A4E claim in their website that jobs are "carefully" matched to the "skills and abilities" of their customers!

Anyway, Declan has also informed the THT that I too have to withdraw my name. Clearly A4E will likely put me in a work boost when it pleases them, so I might as well do it now and volunteer for the THT after my mandatory four weeks are done.

A4E: Fifth breach of contract

So much for my previous blog A4E: Letter to the Chairman, Emma Harrison CBE! Action for Employment (A4E) explains that they support their customers by "Working with you to review where you are now, find out your goals and aspirations and what type of job you are looking for". But that is not so, according to Lola Worth, A4E Camden Placement Advisor, who, without even having seen Declan's CV or our website (or so she says), unceremoniously provided him yesterday with his fifth breach of contract against A4E since 29 September 2010.

These are the five breaches of contract on Declan's joint claim for Jobseeker’s Allowance, with Ms Worth coming in at number 5 (each breach of contract was brought to the immediate attention of Harrison):

(1) the refusal to assist me in my search for employment;
(2) the refusal to issue me a Journey Plan;
(3) the tampering and altering of the Journey Plan I signed on 13 September 2010;
(4) the tampering and altering of the Journey Plan Declan signed on 20 October 2010;
(5) the refusal to assist Declan with relevant “work boosts”.

Declan just dispatched this (umpteenth) email/letter to Harrison, in which he lists all five breaches:

This dispute is currently before Mr Justice Sycamore of the High Court (see blog of 3 December 2010 By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review). But that seems to be cutting no ice with A4E! Perhaps a small claim in the small claims court will bear better fruit.

Website brought down as we are about to publish our first book excerpt from a Nobel Prize winner

The illegal surveillance of our activities online hasn’t ceased one bit, despite Declan’s most recent letter just a couple of weeks ago to our MP, Lynne Featherstone, a minister in the Home Office, regarding the on-going interception and manipulation of our email and Facebook’s selection of our IP addresses for special treatment (see blog of 27 January Facebook: Letter to our MP). This time it’s pretty outrageous: Declan was just about to publish our first exclusive book excerpt from a Nobel Prize winner when the MonChurch website was brought down (no kidding). Wordpress says there is no contact with the database and suggests that I check if Siteground’s database server is down, but Siteground is reporting that everything is OK.

Wordpress’s other suggestion is that the username and password in my wp-config.php file is incorrect, which can only mean that somebody has accessed our Wordpress file and changed both details. Yep, that easy! No doubt if somebody did that to a government department or agency, they would be put away for a few years – too bad it doesn’t work both ways. I'm curious to know what kind of warrant is necessary for this sort of assault on basic civil liberties, especially when we are clearly providing an important public service ... Perhaps Minister Featherstone will tell us none!

Facebook: Letter to our MP

Our problems with Facebook are getting worse. After spending a bunch of hours attempting to get our new fan page for Network for Church Monitoring around, I have almost nothing to show for it. Now our wall has been vandalised! In the previous blog, What has Facebook done with our IP addresses?, I wrote that Declan was going to write to our MP, Lynne Featherstone, a minister in the Home Office, to inquire if Facebook has been given some sort of instruction with respect to our IP addresses. Little did I know that his email would include the vandalisation of our wall:

Declan is still waiting to hear from Mr Justice Sycamore regarding his claim for judicial review (see blog of 3 December 2010 By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review). Yet this afternoon we once again ran into our local jobcentre, Highgate Jobcentre Plus. The Customer Service Manager Taru Shah would not permit the following information to be held on their computer system (see blog of 21 January A4E: Third breach of contract and very serious misconduct):

Customer delivered by hand for the attention of Patrice Mulligan a copy of her complaint of 21 January against her A4E Advisor, Greg Janiszek, for very serious misconduct. Customer has asked me to write this.

What they wouldn't register for the manager by hand, Declan will be sending to the manager by registered post tomorrow. Who knows what’s cooking between this jobcentre and A4E Camden? But, whatever it is, we are up for it: Court of Appeal, Small Claims Court and/or Tribunal. Declan actually saw this coming in his application for urgent consideration of his claim for a judicial review:

What has Facebook done with our IP addresses?

This afternoon I had to go to the local internet cafe to get a Facebook page for Network for Church Monitoring, now a registered company (see blog of 17 January Companies House refuses to register NAC: "Offensive company name"). I tried at our flat with both my laptop and Declan's notebook but was prevented from doing so: Facebook kept asking me to provide a response for their security check without providing me the security check to respond to! I tried with all my browsers and even deleted my browsers' history, but to no avail. What has Facebook done with our IP addresses?

Declan will write to our MP, Lynne Featherstone, a minister in the Home Office, to inquire if Facebook has been given some sort of instruction with respect to our IP addresses (see blog of 19 January Manager of A4E Camden tries it out ... again!; in this blog I publish a letter from Featherstone confirming that she has written to the Home Secretary regarding the unlawful violation of our basic right to send and receive email without interference.) Only this month the US Department of Justice sent subpoenas to Google, Facebook and Twitter demanding that they hand over information on those closely associated with WikiLeaks. It was Twitter that broke the story. Rop Gonggrijp, one of WikiLeaks' associates praised Twitter, stating: "Heaven knows how many places have received similar subpoenas and just quietly submitted all they had on me".

A4E: Third breach of contract and very serious misconduct

I am tired of blogging about Action for Employment (A4E), a private company that, as the interviewer in the video above points out, has received £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions. I am also tired of writing to its founder and chairman, Emma Harrison CBE, and so is Declan. This time the company has crossed the line with me, though, and I am now looking at my A4E employment officer, Greg Janiszek, for patently illegal activity, if not criminal:

A4E are actually contracted by the Government to help us find work experience: on-the-job training and support consisting of a month of full-time unpaid work. Declan and I are seeking our "work boost" with a premier not-for-profit organisation. Already Janiszek is making excuses ... you would think that with £300 million of Government training contracts this company would have little difficulty providing people with relevant training and support?

A4E refuse me a Journey Plan

If Declan thought he had it blase with the manager of A4E Camden yesterday (see previous blog), it was nothing on my encounter this morning with my A4E employment officer, Greg (he has told me that I can no longer write his surname in my blog!). Bottom line here is that Declan has just informed the chairman and owner of this private company that, within two weeks of this email/letter to her, he will file his claim in the small claims court against A4E for proper damages, relatively speaking (see blog of 6 January Manager of A4E Camden Declan's new Personal Career Coach; this blog features a video of Declan taking on A4E last September outside of a branch of theirs in London that had him escorted from the building by the police the week previous):

Among Greg's many contentions is that I am making "excuses" for my non-use of my email account to apply for jobs. There is no supplying this employment officer with evidence that my email account is hacked and my online movements monitored. In yesterday's blog, I published a letter from a Home Office minister on the issue. This is another email/letter that I have brought to Greg's attention on several occasions which speaks of "(what appears to be) outrageous manipulation of the Heaveys' email" and that the distinguished McKnight Professor Emeritus from America is "truly appalled by the unlawful violation of the Heaveys' basic right to send and receive email without interference":

What "excuses"? As the distinguished professor mentioned in the email/letter above, Declan has a petition to the UN that has already been signed by no less than 28 Nobel laureates, but has repeatedly had to shelve it. The last Nobel laureate who signed, Sir Tim Hunt from the London Research Institute, did so with a phone call from Declan. I'm actually finding it difficult to restrain myself here. Declan says there is absolutely nothing he would prefer at this particular time than to have this employment officer on the spot in the High Court (see blog of 3 December 2010 By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review), the Central London County Court (small claims), or a tribunal. Damn, I'm so annoyed that this is the video I mentioned above - of Declan taking on A4E last September outside of a branch of theirs in London that had him escorted from the building by the police the week previous (the letter from the Queen that Declan refers to in this video is archived here):

Manager of A4E Camden tries it out ... again!

If A4E do not want to find themselves in the Small Claims Court on Thursday, they are certainly skating very thin ice (see previous blog). This morning Declan had his first meeting with his latest A4E employment officer, the manager of A4E Camden. Once again this manager, David Lawson, has found himself doing the rounds. This is Declan's email this evening to Lawson's chairman, the Secretary of State for Work and Pensions and the CEO of Jobcentre Plus (of the Department for Work and Pensions):

Lawson had such a blase attitude about Declan's High Court proceedings (see blog of 3 December 2010 By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review) that Declan says it was a chore briefing him. Declan did manage, however, to explain why we are sending all our CVs and application forms to non-profits through the post. This is a letter Declan received last June from our MP, Lynne Featherstone, now a minister in the Home Office, regarding the unlawful violation of our basic right to send and receive email without interference (she has yet to prompt a response into why we have been encountering these problems):

Declan also made a point of letting this employment officer know that his petition to the UN regarding stem cell research, which has already been signed by no less than 28 Nobel laureates as well as hundreds of other distinguished scholars, has once again had to be shelved because almost no scientist was getting his email in their Inbox (see here); that our blog and the NAC website has been hacked and vandalised several times (see here and here); that abuse has been hurled at us via Skype (see here); that over 300 draft documents have been erased from our Gmail account (see here); and that the original NAC website was suspended in March 2008 due to a Spamcop report that was drawn up the day after the Home Office denied that a warrant had been issued to intercept our communications (see here).

As I stated in the previous blog, I have my A4E employment officer, Greg Janiszek, to see tomorrow. Tonight Declan will include me in his claim against A4E that he is fully prepared to file at the Central London County Court (our small claims court) on Thursday. Suffice to say that A4E, in our first six months with them, have wiped us of any little bit of savings we might have had to help us get back on our feet after more than 2 1/2 years sleeping rough on the streets of London because Declan did not "sign on" TWO DAYS BEFORE he was due to do so (see blog of 21 June 2010 Department for Work and Pensions double breaches the Data Protection Act: Letter to the Information Commissioner).

We are incorporated as Network for Church Monitoring Ltd

As I said in yesterday's blog, Companies House, the UK Registrar of Companies, refused to register Network of those Abused by Church as a company because it was an "offensive company name". So we had to change the name and this morning the company was incorporated as Network for Church Monitoring Ltd, a company limited by guarantee. Frankly, Declan and I think the new name is much better: it has a journalistic sound to it, which we believe will improve the perception of the organisation at every level, including with other non-profits. Everybody wants to see accountability and monitoring, including of religious institutions. MonChurch is, I think, an important organisation.

Declan is still waiting to hear from Mr Justice Sycamore regarding his claim for judicial review (see blog of 3 December 2010 By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review). Declan is taking on Action for Employment (A4E), a private company and the largest provider of welfare to work programmes on behalf of the Department for Work and Pensions (see blog of 6 January Manager of A4E Camden Declan's new Personal Career Coach; this blog features a video of Declan taking on A4E last September outside of a branch of theirs in London that had him escorted from the building by the police the week previous).

Declan is in fact fully prepared to file a claim against A4E at our small claims court, the Central London County Court, on Thursday - at 9.30am tomorrow morning he has his first meeting with his latest employment officer, the manager of A4E Camden, who has been informed by the DWP that the provisions of the Jobseeker's Act 1995 do not apply to A4E (we're waiting to hear from Mr Justice Sycamore on that one); on Wednesday I have to deal with my employment officer with whom I have had plenty of run-ins (see blog of 30 September A4E: Letter to the Irish Minister for Justice, Equality & Law Reform).

On Sunday I published another world exclusive in NAC (it will be MonChurch soon!): an excerpt from Debbie Purdy's book, It's Not Because I Want to Die. Purdy - the face of Britain′s right-to-die campaign - suffers from multiple sclerosis. In July 2009 she won a significant legal victory in the UK’s House of Lords which lawyers have described as a turning point for the law on assisted suicide. We are honoured and proud to promote her book, which I found inspirational.

Over the last few weeks, we have published world-exclusive excerpts from books by the eminent human rights lawyer Geoffrey Robertson QC (here), British cultural icon Stephen Fry (here), House of Lords Peer Baroness Mary Warnock (here), as well as the celebrated Debbie Purdy. And that with the wrong name! What is the manager of A4E going to suggest tomorrow, that with a university degree Declan should pack shelves in supermarkets? A4E of course have done absolutely nothing for us; it's the complete opposite, in fact. But more about that later, no doubt, and possibly in more court-filed documents this Thursday.

Companies House refuses to register NAC: "Offensive company name"

This morning Companies House, the UK Registrar of Companies, refused to incorporate NAC as a company. According to Andrew Fletcher, the Head of the Sensitive Words Department, Network of those Abused by Church is an "offensive company name". Maybe if Companies House was located inside the Vatican, they would have an excuse to be annoyed, but in the UK? Oh, and maybe the US organisation Survivors Network of those Abused by Priests (SNAP) should be made aware that if they're ever thinking of opening an office here, they should think first about a new name! Declan has been working very hard on the Articles of Association and wasn't too impressed. This was his email this evening to Fletcher:

We lose the internet at our flat ... again!

Last night we lost our internet connection. One moment I am in Facebook putting around an exclusive excerpt from Baroness Mary Warnock's latest book, "Dishonest to God: On Keeping Religion Out of Politics", and, at the next, I am staring at a blank monitor. Declan's notebook didn't have access to the internet either. I am uploading this blog from the local internet cafe and of course now both Declan and I are subject to being squeezed in public libraries (see blog of 2 April "Back to being 'squeezed' in public libraries").

Manager of A4E Camden Declan's new Personal Career Coach!

Declan is still waiting to hear from Mr Justice Sycamore regarding his claim for judicial review (see blog of 3 December By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review). But this morning, while job searching in Action for Employment (A4E) Camden, he was informed that he has a new Personal Career Coach: THE MANAGER! So David Lawson, the manager of A4E Camden, in addition to his demanding job as a manager is now also going to be Declan's new employment officer. Is it me, or is there a hidden agenda here? At the very least, this most certainly ups the ante on Declan's application to the High Court for a judicial review, and renders an application to the Court of Appeal an absolute certainty should his application be rejected. NAC is back, but no TV for Christmas

The NAC website is back! Too bad I cannot say the same for the TV. After four TV blow-outs in the first ten months of this our first tenancy off the street, our brand new fifth TV has been a virtual write-off for almost three weeks now (see blog of 14 December TV in the New Year, Declan is assured). As I have mentioned in several blogs this month, MI5 whistleblower David Shayler lived for a couple of years in one of the rooms below us. According to the BBC's Panorama programme, Shayler “caused the biggest crisis of official secrecy since the spy catcher affair”. Shayler, who now goes by the name of Delores Kane and has declared himself to be Jesus, is the one sitting on the chair:

Declan threatens Just Host with Small Claims Court

NAC was unceremoniously pulled down by Just Host last Thursday (see blog of 16 December NAC is removed from the Internet for the fourth time). Now we are with Siteground (see blog of 17 December American sponsor pays for new server), but we're still off-line because we can't get the domain churchandstate.org.uk from Just Host. Declan has just charged Just Host with theft and threatened them with the Small Claims Court. This is no idle threat, as already this month Declan has brought the Secretary of State for Work and Pensions before a High Court judge (see blog of 3 December By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review).

This is an extremely interesting video of Michael Moore talking to Rachel Maddow about WikiLeaks. One of the WikiLeaks cables just posted reveals that the US forced the cancellation of New Zealand screening of Michael Moore's "Fahrenheit 911". Moore makes the important point that if the government went after the screening of a film in New Zealand, "What else are these guys up to?" Excellent point, and I am sure the same applies to the British government.

Just Host unceremoniously pulled down the NAC website last Thursday (see blog of 16 December NAC is removed from the Internet for the fourth time). Now we can't get the domain churchandstate.org.uk from them. As things stand, only my IP has access to the site.

American sponsor pays for new server

As I explained in the previous blog NAC is removed from the Internet for the fourth time, Just Host pulled the NAC website down yesterday after only four months - I had paid them through to 2015! On the plus side, today NAC Chair Dr Stephen Mumford has paid Siteground, voted the best web hosting company for 2008 and 2009, for 1 year of service and is happy to fund the NAC site indefinitely.

Dr Mumford is the foremost authority on population growth and US and global security. He is the founder and president of the Center for Research on Population and Security. He has written extensively on the pivotal role of the Catholic Church hierarchy in thwarting efforts to tackle the world’s burgeoning population.

Dr Mumford gave a talk on “Infallibility and the Population Problem” at this years’ fourth annual Population Strategy Meeting, which is the most important population meeting held in the US each year. He illustrated how the Vatican has shown itself to be in opposition to population concerns, and that the doctrine of papal infallibility underlies their behaviour. I have his presentation in the NAC website and hope it will become popular in Facebook. It very much represents the heart and soul of the NAC website, which focuses on reproductive health in particular. Hopefully I will have it back on line tomorrow.

NAC is removed from the Internet for the fourth time

Our new web host, Just Host, notified us this evening that they were pulling the NAC website down. They didn't even provide us with notice - within seconds of an email from them, the site was gone. Fortunately I had everything backed up just before we came down because I noticed we had an article that was going viral (a NAC first) and I told Declan we may very well lose the site, for the fourth time (I would say see NAC "About", but I can't). Their explanation: "Your account is utilizing an excessive amount of system resources". Really? Last month we had 18,819 visits; so far this month, 9,939 visits. And where was the notice that I may have needed to save all my work? We had actually paid Just Host to host the NAC website through to 2015.

Declan runs into the Administrative Court Office ... again!

The Administrative Court Office (ACO) of the High Court of Justice Administrative Court has Declan's number or what? On Friday Declan had to threaten to write to ACO Court Manager David Brupbacher to get them to seal his resubmitted claim (see blog of 3 December By Order of Mr Justice Sycamore Declan resubmits his claim for judicial review). This morning he had to threaten them with the same just to get them to seal two Certificates of Service. Goodness knows what it will be the next time (possibly with the Civil Appeals Office), so this was Declan's start up with Brupbacher this evening (click to enlarge):

This afternoon Declan ran into the Administrative Court Office (ACO) of the High Court of Justice Administrative Court in a major way. They made out that Mr Justice Sycamore did not order Declan to resubmit his claim for judicial review (see the Judge's order here). Only after Declan threatened to put the Judge's order before ACO Court Manager David Brupbacher did they seal the resubmitted application against the Secretary of State for Work and Pensions. Declan's entire case is summarised in the one paragraph contained in Section 5, "Detailed Statement of Grounds" (click to enlarge):

It would appear the writing is on the wall. Bottom line here is that if the High Court and the Court of Appeal throw out Declan's case, he will be once again making an application to the European Court of Human Rights pursuant to Article 8 of the European Convention on Human Rights protecting the right to respect for family and private life (see blog of 21 October 2008 European Court of Human Rights declares application inadmissible).

WMC: Declan pleads extreme financial hardship

Declan has come home this evening to the reply Mr Justice Sycamore of the High Court ordered the Department for Work and Pensions (DWP) to provide him with in respect to his claim for judicial review (the Judge's order is contained in the previous blog Judge issues order in Declan's case and more problems with our TV). Surface it is to say that the letter that the DWP has written and their summary grounds for dismissal of Declan's case are in blatant disregard for the provisions of section 9 of the Jobseekers Act 1995 (see blog of 13 November Declan's claim for judicial review). Mr Justice Sycamore also ordered that Declan resubmit his claim, if he still wishes to do so, after hearing from the DWP. He fully intends doing so, and promptly, despite having to declare "extreme financial hardship" in this email of complaint earlier this afternoon to Satnam Gill OBE, the principal and chief executive of The Working Men's College (WMC), one of London's premier adult education colleges:

This video of best selling author Christopher Hitchens debating Tony Blair in Canada last Friday, on whether religion is a force for good or ill, is the most popular video I have ever posted on the NAC website. I posted it on Saturday night and already over 200 people have shared my page through Facebook. When I listen to Hitchens I can't help thinking how sad it is that his voice will soon be cut short. He is terminally ill with cancer.

Judge issues order in Declan's case and more problems with our TV

The Department for Work and Pensions (DWP) has been ordered by Mr Justice Sycamore of the High Court to reply to Declan's claim for judicial review, and Declan ordered to resubmit the claim on the Judge's terms (see blog of 13 November Declan's claim for judicial review). We are more than interested to receive the DWP's reply. Declan says that most certainly he will be resubmitting his claim notwithstanding the Judge's terms (click to enlarge):

Department for Work and Pensions will reply to a judge, not to Declan

It is just as well Declan has his appeal pack for the Court of Appeal. This is the response (not a reply) he received in this afternoon's post from the Department for Work and Pensions (DWP) to his letter before claim for judicial review against our jobcentre, Highgate Jobcentre Plus (click to enlarge):

Declan is aware he will only have seven days to appeal a High Court judge on his request for permission to apply for a judicial review of the Jobcentre's decision of 13 September not to adhere to the provisions of Section 9(6) of the Jobseekers Act 1995 (see previous blog). His claim against A4E for our small claims court, the Central London County Court, is already written up and, based on current circumstances, ready to file (see previous blog, paragraph 2).

What is it that the DWP wants the Court to read that they don't want Declan to see first? Well, I look forward to blogging it!

On Thursday Declan applied to the High Court for a judicial review of Highgate Jobcentre Plus’s decision of 13 September not to refer A4E Holloway's proposed jobseeker's agreement to the decision maker (the Secretary of State) in accordance with Section 9(6) of the Jobseekers Act 1995. The Jobcentre neither replied to the Declan’s appeal of 22 September, nor forwarded his appeal to the Tribunals Service for a ruling whether the appeal may go ahead or not. They then failed to reply to the letter before claim (see blog of 28 October The High Court (Judicial Review): Letter before claim). A4E (Action for employment) is a private company, and the largest provider of welfare to work programmes on behalf of the Department for Work and Pensions (DWP). On Wednesday my A4E Personal Career Coach Greg Janiszek told me that we shouldn't be wasting so much time writing letters. Well, he hasn't seen anything yet, because Declan intends taking legal action against A4E for compensation in the Small Claims Court. For the last three months they have given us an absolute nightmare on every conceivable front and wiped us of the little bit of money we had to get back on our feet. And this after we were forced by the DWP to sleep rough on the streets of London for more than 2 1/2 years because Declan did not "sign on" TWO DAYS BEFORE he was due to do so on 29 September 2006 (see blog of 21 June Department for Work and Pensions double breaches the Data Protection Act: Letter to the Information Commissioner). A4E Camden: Declan claims breach of contract

For two months now I have been writing that I don't have the documentation of an illegal immigrant to establish my identity. We were robbed of all our money and documents in the Sisters of Mercy's Dellow Day Centre in 2008, and the case was thrown out because the nuns refused to provide the police with CCTV coverage of the robbery (see blog of 4 September Sisters of Mercy revisited - our first YouTube video). It doesn't seem to matter who Declan or I write to, we cannot get Broadway Homelessness and Support to confirm that they will assist me with requesting my Irish Citizenship Certificate from Dublin (see blog of 13 September Broadway will help me become a Spanish citizen!) - it took Broadway over a year and three applications to retrieve Declan's birth certificate from Ireland!

It also very much looks like Declan will be filing his claim for judicial review against Highgate Jobcentre Plus in the High Court on Thursday week (see previous blog The High Court (Judicial Review): Letter before claim). Not only has the Jobcentre failed to forward his appeal for breach of Section 9(6) the Jobseekers Act 1995 to the Tribunals Service for a ruling whether the appeal may go ahead or not, but they have yet to respond to his judicial review "letter before claim" (published in the previous blog). He already has the judicial review claim form (N461) written up and ready to file!

This is an outstanding video which I uploaded to the NAC petition page regarding SCNT or "therapeutic cloning". I have mentioned throughout this blog that Declan's petition to the UN on this essential research has had to be shelved several times because almost no scientist was getting his email in their inbox (notwithstanding that the petition has been signed by no less than 28 Nobel laureates as well as hundreds of scholars and scientists, including recognised authorities from the world's leading universities and research institutes). It's hard to know what it will take to be able to protect our private communications.

The High Court (Judicial Review): Letter before claim

Jobcentre Plus (JCP) is an executive agency of the Department for Work and Pensions. It was JCP that put us to the street in 2006 and kept us there for more than 2 1/2 years because Declan didn't "sign on" TWO DAYS BEFORE he was due to do so on 29 September 2006 (see blog of 21 June 2010 Department for Work and Pensions double breaches the Data Protection Act: Letter to the Information Commissioner). Their unaccountability then went all the way - Declan exhausted the appeals process from the street, where his case was dismissed by Mr Justice Walker of the High Court (Judicial Review), Lord Justice Scott Baker of the Court of Appeal and the European Court of Human Rights despite that he was denied the internal appeals process by procedural impropriety on the part of the enforcement authority.

Last month Declan appealed the decision of our jobcentre, Highgate JCP, not to refer proposed variations of his jobseekers agreement to the decision maker (the Secretary of State) in accordance with Section 9(6) of the Jobseekers Act 1995. Just as we expected they would, the Jobcentre has simply ignored the appeal (archived here). It is a loophole in the Jobseekers Act that although a jobcentre must forward proposed variations of a jobseekers agreement to the decision maker if asked to do so by the claimant, there is no way for the claimant to force compliance. This time around, with a roof still over our heads, Declan is wasting no time with the pre-action protocol for judicial review (click to enlarge):

With the advent of the “War on Terror”, the role of religion in political conflicts has become paramount and NAC, responding to the challenge, has broadened its scope to question the premises upon which the “war” is based. Last week WikiLeaks released the largest classified military leak in history. The 391,832 reports ('The Iraq War Logs'), document the war and occupation in Iraq from 1 January 2004 to 31 December 2009 (except for the months of May 2004 and March 2009) as told by soldiers in the United States Army. According to the BBC, the leaking of the documents is likely to increase pressure on governments to release details of civilian casualties in future conflicts.

Also last week, the UK Government published the post-mortem report on British weapons inspector Dr David Kelly. Kelly's body was found in woodlands close to his Oxfordshire home in 2003, after it emerged that he had given information for a BBC news story questioning the government's claim that Iraq had weapons of mass destruction. In their article Did MI5 kill Dr David Kelly?, Global Research reported that Kelly was planning to write a book that could have violated the Official Secrets Act.

The Mary Ward Centre is one of London's premier adult education colleges. This morning its Principal Ceri Williams requested that I update my blog to include copies of her replies to my complaint against the college for threatening me with expulsion (see blog of 2 October Mary Ward Centre threatens me with expulsion). As I stated in the previous blog, it turns out that I have been the victim of an "administrative error", but I had been concerned that our jobcentre could have taken our benefits because I am not turning up for courses (see blog of 4 October Mary Ward Centre: Letter to Principal Ceri Williams)!

Declan already has the jobcentre, Highgate Jobcentre Plus, on appeal for not referring proposed variations of his jobseeker’s agreement to the decision maker (the Secretary of State) in accordance with section 9(6) of the Jobseeker’s Act 1995 (see an extract from the appeal in blog of 21 September Two allegations against Declan within a week!). If they don't respond within the next two weeks, he will be applying for a judicial review. The Mary Ward Legal Centre specialises in Welfare Benefit Law. The last thing we needed this week was an uncontested allegation from the Mary Ward Centre that I am one of their "non-attenders".

The Mary Ward Centre is one of London's premier adult education colleges. In Saturday's blog Mary Ward Centre threatens me with expulsion, I published a letter I received that morning from the college's Head of Computing, IT and Business Clive Allum informing me that I didn't notify them I wouldn't be attending their two-day course "Excel Introductory" on 23 and 30 September, adding, "As a result we have to cancel any future computing enrolments you may have on our system." Well, it turns out that I have been "the victim of an administrative error", according to Vice Principal Suzanna Jackson this afternoon.

I had been concerned that if the college did not rectify this situation, our jobcentre could have taken our benefits since I am not turning up for courses! For the record, this is the email I sent this morning to the college's Principal Ceri Williams, copied to her Chair Diana Good (a former litigation partner at Linklaters, one of the UK's highest ranking law firms, who has a part time judicial appointment):

Mary Ward Centre threatens me with expulsion

Today I received a letter from the Mary Ward Centre, one of London's premier adult education colleges, whose aim it is “to promote public education and social service for the benefit of the community”. They say that I didn't notify them I wouldn't be attending their two-day course "Excel Introductory" on 23 and 30 September, adding, "As a result we have to cancel any future computing enrolments you may have on our system."

In fact, not only did I go to the trouble of turning up in person at the college on 21 September to explain why I may be up to two hours late for the first lesson on 23 September, but Declan turned up with me. And the valid reason I had for having to be late was that on the morning of 23 September we had to sign on at our local jobcentre; and although a claimant can arrange to sign on another day if he has a good reason, things were way too rough for us with the jobcentre to even consider doing so (see blog of 21 September Two allegations against Declan within a week!). The person who the enrolment officer put me through to on the telephone to explain all this was the Head of Computing, IT and Business, Clive Allum. This is the letter I received this morning from Allum:

Allum was adamant when we spoke over the telephone that students couldn't be more than 30 minutes late for a class no matter what the excuse and that they had to cancel my enrolment for the course in question. As a result I also had to cancel my enrolment for the follow-up course "Excel Advanced" and was lucky to get a place on a six-week Microsoft Office course, which I have attended the last two Fridays. It is not clear from the letter above if my enrolment on this course has now been cancelled too.

First thing on Monday morning, Declan and I are back to the college to hand-deliver a letter addressed to the Principal, Ceri Williams, which will also be dispatched by registered post. This is not the first time I have had to deal with this college. Last June they informed me via email that the follow-up course I had booked, "Access Advanced", had been cancelled due to a lack of interest, and they then sent my refund cheque to the wrong address (see blog of 22 June The Mary Ward Centre).

The Mary Ward Centre is a registered charity. According to their website, "The Mary Ward is the friendly place to learn"; and even better, "All Centre staff know about the importance of customer care and are proud of the reputation the Centre has for treating people right." What is going to happen on Monday? Am I going to be told that in effect I am expelled from the college for the rest of the academic year?

A4E: Letter to the Irish Minister for Justice, Equality & Law Reform

As I said in the blog of 22 September A4E: Letter to City of London Police Commissioner Michael Bowron, I am more undocumented than an illegal immigrant following the robbery in June 2008 of all our money and documents in the Sisters of Mercy's Dellow Day Centre for the homeless - for more than 2 1/2 years we were forced to sleep rough on the streets of London by the Department for Work and Pensions (DWP) because Declan did not "sign on" TWO DAYS BEFORE he was actually due to do so on 29 September 2006 (see blog of 21 June Department for Work and Pensions double breaches the Data Protection Act: Letter to the Information Commissioner). It has taken Broadway Homelessness and Support more than a year to retrieve Declan's birth certificate from Ireland (see blog of 10 September Broadway Homelessness and Support), and they have yet to agree to assist me with requesting my Irish Citizenship Certificate so that I can be reissued an Irish passport (see blog of 13 September Broadway will help me become a Spanish citizen!). This afternoon I even received an email from the Private Secretary to Irish Minister Dermot Ahern. Declan will send this thread to him by registered post tomorrow (the letter from the Papal Nuncio regarding the Sisters of Mercy is published here):

This afternoon I ran into my A4E (Action for Employment) employment officer Greg Janiszek in a major way - A4E is a private sector company that has £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the DWP. Janiszek had the cheek to tell me that the reason why I have not gained meaningful employment is because I am sending all my CVs and application forms to non-profits through the post! He is of course well aware that Declan has written to our MP Lynne Featherstone, now a minister in the Home Office, asking her to be of assistance "in correcting the unlawful violation of our basic right to send and receive email without interference" (see blog of 21 April Interception of communications: Declan writes to our MP). This is her most recent letter to Declan, which I have shown Janiszek on more than one occasion (click to enlarge):

Janiszek is also aware that Declan's petition to the UN regarding stem cell research has been shelved several times because almost no scientist was getting his email in their Inbox (see here); that our blog and the NAC website has been hacked and vandalised several times (see here and here); and that abuse has been hurled at a NAC Honorary Associate via Skype (see here). I am not sure if I have told him that in 2008 over 300 draft documents were erased from our Gmail account (see here). But certainly I have informed him, and more than once, that the original NAC website was suspended in March 2008 due to a Spamcop report that was drawn up the day after the Home Office denied that a warrant had been issued to intercept Declan's communications (see here).

No employer or agent has ever got back to either of us to tell us we are living in the twentieth century! We are doing our very best to find employment despite all the obstacles. Between two training courses (Declan actually attends a third training course on Saturdays - of no interest to A4E because it is in his "free time") and travelling to and from an allocated A4E branch that is not even in our own borough (our local A4E branch happens to be less than a ten-minute walk away from our flat), we do not have the time for a window-dressing exercise through Gmail. We have to get through to employers, and the only way to do that is to send CVs and application forms through the post, notwithstanding the time, trouble and expense.

My Irish Citizenship Certificate aside (Janiszek has asked me not to send him any more emails regarding this matter), why doesn't this employment officer facilitate my efforts by getting me the work experience I need - work experience they are obliged to provide me with and which I am repeatedly asking him for? Neither has Janiszek lifted one finger to help me get onto a training course. A4E, a private company, is the largest provider of welfare to work programmes on behalf of the DWP. Who is in breach of contract here?

It is always something with Highgate Jobcentre Plus

This morning I had my first bit of luck in a long time! Our jobcentre, Highgate Jobcentre Plus, couldn't find the form I sign to make sure our benefits are paid in full next Tuesday, only to discover that it was actually in my file all the time. Phew!

Declan has spent two months now writing to the manager of this jobcentre. When we signed on two weeks ago, it was more of the same: what letters? (see blog of 9 September Highgate Jobcentre Plus doesn't disappoint). Surely in two weeks time, after this letter to the manager, it won't be "What Appeal?" (see blog of 21 September Two allegations against Declan within a week):

World Contraception Day 2010 takes place on 26 September. The Catholic church wouldn't agree at all, but lack of effective sexual reproductive health is a key factor contributing to the problems of population growth and population growth is one of the driving forces behind the growth of greenhouse gas emissions that cause climate change. Does this not make the Vatican one of the great carbon polluters of the world?

What a nightmare the robbery of all our money and documents in the Sisters of Mercy's Dellow Centre - the same morning Declan was due to send his second Request for Priority to the European Court of Human Rights from the street (see here) - is turning out to be. In the blog of 11 September City of London Police in the spotlight, I published an email of reply from the head of the City of London Police, Commissioner Michael Bowron, signed by Superintendent Lorraine Cussen, threatening us with physical removal from the porch we were sleeping in - the very same day we dramatically came off the street! In this email, it was also suggested that we seek the assistance of Broadway Homelessness and Support, a premier homelessness organisation in London. Well, it has taken Broadway more than a year to retrieve Declan's birth certificate from Ireland (see blog of 10 September Broadway Homelessness and Support), and they have yet to agree to assist me with requesting my Irish Citizenship Certificate so that I can be reissued an Irish passport (see blog of 13 September Broadway will help me become a Spanish citizen!).

In this thread to Commissioner Bowron, Action for Employment (A4E) are back in the frame (see blog of 18 September A4E continues to flout the law despite Declan's appeal). A4E is a private sector company that has £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions. Two allegations against Declan within a week!

In the blog of 16 September Jobcentre confirms A4E broke the law, I wrote that our jobcentre, Highgate Jobcentre Plus, had something cooking when they sent a letter to Declan calling him for an interview today to discuss a "query" on our claim to benefits. Well, we attended the interview only to be informed that somebody had told the Jobcentre that Declan was getting paid as the director of NAC! The grilling lasted almost 40 minutes, but at the end of it all, the compliance officer told us "the doubt has been removed". Declan's statement reads (archived here):

I maintain a website with my wife at churchandstate.org.uk (NAC) on a voluntary basis. This does not affect my job seeking in any way. It is voluntary work carried out in my free time outside my job seeking pursuits. NAC is not registered as a company, although I am working in my free time to that end. I am not formally a "director", therefore, and I do not get paid. I have submitted with this statement bank statements going back four months. I refute the allegation made against me (by an unknown source) completely.

This is of course the second allegation against Declan within a week. The first allegation came compliments of Action for Employment (A4E) - a private sector company that has £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions. They tyrannically allege, having seriously breached section 9(6) of the Jobseekers Act 1995 by denying Declan the Decision Maker (the Secretary of State) on proposed variations of his jobseeker's agreement, that he has been disruptive in our local A4E branch (see blog of 14 September Declan appeals A4E). They have also transferred him back to a branch which he requested a transfer out of due to ease of travel (see previous blog A4E continues to flout the law despite Declan's appeal). A4E continues to flout the law despite Declan's appeal

Action for Employment (A4E), a private sector company that has £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions, continues to flout the law despite our jobcentre confirming in writing that they broke it (see previous blog Jobcentre confirms A4E broke the law) and Declan's appeal against them for an Appeal Tribunal (see blog of 14 September Declan appeals A4E).

Rather than this provider choosing to refer their Holloway branch's proposed jobseeker's agreement to the Decision Maker (the Secretary of State) in accordance with section 9(6) of the Jobseekers Act 1995, they have transferred Declan back to their Camden branch. Because we have to put a minimum of 8 hours per week there using the computers to look for work, Declan wasn't too keen about wasting more than an hour travelling back and forth and asked to be transferred to the Holloway branch, which is no more than a ten minute walk away for us. This is from A4E:

After more than a year of Broadway Homelessness and Support trying to obtain Declan's birth certificate from Ireland (see blog of 10 September Broadway Homelessness and Support), yesterday it finally arrived in the post ... in an envelope addressed to S Riches! On 18 June 2008 we were robbed of all our money and documents in the Sisters of Mercy's Dellow Centre (see blog of 4 September Sisters of Mercy revisited - our first YouTube video; this blog also contains a letter from the Papal Nuncio). I have asked my A4E employment officer to inquire of Broadway whether they are willing to assist me with requesting my Irish citizenship certificate (see blog of 13 September Broadway will help me become a Spanish citizen!). To up the ante on this request, I have not only copied everyone au fait with the robbery into this email to him, but added the Irish Minister for Foreign Affairs to the list:

In the previous blog, I published Declan's appeal against A4E for unfair treatment. Well, we now have a letter to hand from the manager of our jobcentre, Highgate Jobcentre Plus, confirming that A4E broke the law.

On 16 August, Declan requested both verbally and in writing that A4E refer a proposed jobseeker's agreement of theirs to the Decision Maker (the Secretary of State) under section 9(6) of the Jobseekers Act 1995. This section states quite clearly that "The employment officer may, and if asked to do so by the claimant shall forthwith, refer a proposed jobseeker’s agreement to the Secretary of State". According to the Jobcentre, this referral was never made by A4E:

In fact, A4E's flouting of the law took place right under the nose of this manager (see blog of 9 September Highgate Jobcentre Plus doesn't disappoint), as well as A4E chairman and owner, Emma Harrison CBE. Declan has also been writing to new Secretary of State for Work and Pensions Iain Duncan Smith (see blog of 8 September Letter to the Secretary of State for Work and Pensions). Of course, it was the DWP that forced us to live rough on the streets of London for more than 2 1/2 years because Declan did not "sign on" TWO DAYS BEFORE he was due to do so on 29 September 2006 (see blog of 21 June Department for Work and Pensions double breaches the Data Protection Act: Letter to the Information Commissioner). This letter also arrived from the Jobcentre in yesterday's post (you wouldn't know what they have cooking):

And I think it's important that people can do that. And it's important for the church to be listening to people's concerns and issues. I think that is very important."

Declan has put in an appeal for an Appeal Tribunal against Action for Employment (A4E) - a private sector company that has £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions. Basically, he has now received an electronic copy of a letter that has yet to arrive in the post but, within two paragraphs, this letter is both breaking the law and making serious and unfounded allegations against Declan (click to enlarge). Who has the credibility problem?

It seems that A4E are like the police and can't investigate themselves (see blog of 11 September City of London Police in the spotlight). In fact, they are quite dangerous: request a decision maker on a proposed jobseeker's agreement in pursuance of Section 9(6) of the Jobseeker's Act 1995 and you are lucky if you don't find yourself in a Magistrates Court for a breach of the peace! And all of this under the nose of the A4E chairman and owner, Emma Harrison CBE, and the manager of our jobcentre, Highgate Jobcentre Plus (see blog of 9 September Highgate Jobcentre Plus doesn't disappoint).

A4E now either re-investigate Declan's case for unfair treatment or he will make sure it sees an Appeal Tribunal. He is also willing to file this case in court down the line. As I said in the previous blog, Declan has repeatedly asked Broadway Homelessness and Support, a premier homelessness organisation in London, to assist me with requesting my birth certificate from Madrid so that I can be reissued an Irish passport - on 18 June 2008 we were robbed of all our money and documents in the Sisters of Mercy's Dellow Centre (see blog of 4 September Sisters of Mercy revisited - our first YouTube video). My A4E employment officer has now agreed to contact Broadway. To further up the ante, I have copied this letter to just about everyone au fait with the robbery (the blog of 4 September just mentioned carries a letter from the Papal Nuncio):

Broadway Homelessness and Support, a premier homelessness organisation in London, has been trying to obtain Declan's birth certificate from Dublin for over a year now with no result (see Friday's blog Broadway Homelessness and Support). This arises from the robbery on 18 June 2008 of all our money and documents in the Sisters of Mercy's Dellow Centre (see blog of 4 September Sisters of Mercy revisited - our first YouTube video). Declan has also repeatedly asked Broadway to assist me with requesting my birth certificate from Madrid so that I can be reissued an Irish passport. They are willing to assist me with requesting a Spanish Identity Card - just about the last thing on my mind! Anyway, this is Declan's latest email to them, copied to those he emailed on Friday when we decided to up the ante on all this:

As I stated in the blog of 14 August Declan pays £100 to be linked to the cable TV network in the house (this blog contains stunning photos of MI5 whistleblower David Shayler who lived for a couple of years in one of the rooms below us), we've had four TV blow-outs in less than 10 months. Although we have yet to be connected to the cable TV network in the house, we have an explanation for the TV blow-outs. It turns out to be a wet cable section - psychotronic attack ruled out! - and likely pockets of water in the cable due to a combination of a connection without waterproof insulating tape and a damaged cable. Phew!

In the blog of 8 September Letter to the Secretary of State for Work and Pensions, I put the trailer for the new film Psywar: The real battlefield is your mind which features among others Noam Chomsky, the late Howard Zinn, Peter Phillip of Project Censored and Just Jhally of Media Education Foundation. The film is first class. Watch a few minutes of this and you'll be hooked. Seriously informative.

NAC blog is hijacked and vandalised

Goodness! I hadn't even finished uploading the previous blog City of London Police in the spotlight, when Declan called to tell me that Friday's blog Broadway Homelessness and Support had been hijacked and vandalised! He was right ... the first graphic I had - a letter that Declan wrote to Broadway requesting they chase up my birth certificate from Madrid (back now) - had been changed without us knowing it.

Of course, I have now changed all passwords, although I do that quite often. Oh, check my blog of 20 January DISCLAIMER: THIS BLOG IS HACKED for, among other things, a hacker's abuse of a NAC Honorary Associate via Skype. At the end of the previous blog I write: "Well, how threatening can a network of those abused by church be that has 33 Honorary Associates, scholars of every sort - scientists, theologians, sociologists, literary critics, philosophers and more?"

Well, perhaps the answer is VERY!

City of London Police in the spotlight

As I showed in yesterday's blog, when we were robbed of all our money and documents (including birth certificates, passports, academic qualifications, etc) in the Sisters of Mercy's Dellow Centre, the Metropolitan Police wrote to Declan a year later in such a manner that someone could have made out that the robbery didn't even take place. Moreover, the opposition to us obtaining new documentation is so great that Broadway Homelessness and Support, a premier homelessness organisation in London, haven't even been able to get Declan's birth certificate from Dublin in over a year of trying, and have yet to agree to assist me with requesting my birth certificate from Madrid.

Throughout our more than 2 1/2 years sleeping rough on the streets of London we were also dealing with the City of London Police. This is an email from the head of the City of London Police, Commissioner Michael Bowron, threatening us with physical removal from the porch we were sleeping in the very same day we came off the street (see also blog of 12 July 2009 Police threaten us with physical force at the place we sleep, Salters):

In this two-minute extract from our first YouTube video (see blog of 4 September 2010 Sisters of Mercy revisited - our first YouTube video), Declan speaks at Salters' Hall of our dramatic exit from the street. (Declan mistakenly states in this extract that we slept in the porch at the back of Salters' Hall for near on a year "from December to January", when he meant to say from December to July. Well, as he says at the outset, this is a draft video!)

When I also explained in the previous blog that we came to England from Dublin in 2003 and for two years attempted to start a network of those abused by church with our own money and how the opposition we encountered was so strong that we had no choice but to go on benefits in 2005 - a year later we were forced to the street - I wasn't joking. In August 2004, for example, we woke up one morning to find that the people living in the flat above us (our flat was the one that doesn't have its windows open) had flooded our kitchen and bathroom. If Declan hadn't been able to disconnect the electricity in the bathroom in time, who knows how things might have turned out.

Well, we all know what happens when the state decides to target somebody. Just ask Julian Assange of Wikileaks. In the UK, we have the example of MI5 whistleblower David Shayler - as Declan mentions in the video clip above, we are actually tenants in the same house Shayler lived in for a couple of years - who now goes by the name of Delores Kane, and has declared himself to be Jesus (see blog of 2 June More electronic harassment? Fifth TV rendered useless for a still of the shocking photo of Shayler that flashes up in the video clip). According to the BBC's Panorama programme, Shayler “caused the biggest crisis of official secrecy since the spy catcher affair”. Of course, ordinary folks are supposed to be under the illusion that the west is progressive and freedom of speech is the norm. Well, how threatening can a network of those abused by church be that has 33 Honorary Associates, scholars of every sort - scientists, theologians, sociologists, literary critics, philosophers and more?

Broadway Homelessness and Support, a premier homelessness organisation in London, has been trying to obtain Declan's birth certificate from Dublin for over a year (since August 2009) and they have now confirmed that they are going to try again for the third time - on 18 June 2008 we were robbed of all our money and documents, including birth certificates, passports, academic qualifications and references, in the Dellow Day Centre of the Providence Row Charity run by the RC Sisters of Mercy (see blog of 4 September Sisters of Mercy revisited - our first YouTube video). Declan has repeatedly asked Broadway to request my birth certificate from Madrid but they have yet to agree to do so. This afternoon Declan upped the ante with this email to the organisation - copied to just about everyone! - with zero effect (click to enlarge):

The then head of the Catholic Church in England and Wales, Cardinal Cormac Murphy-O'Connor, in his capacity as Archbishop of Westminster, was informed of the robbery in the Dellow Centre and the fact that the nuns had refused to provide the police with CCTV coverage of it (see blog of 4 July 2008 Second Request for Priority to the European Court). The police got back to Declan in writing a year later (see below). But instead of stating that they closed the case because the nuns wouldn't provide them with the CCTV footage they needed, they go and write that there was not enough evidence! If Declan hadn't emailed the chief executive of Providence Row at the time of the robbery - her office is almost next to the canteen where the robbery took place - the point could be made now that maybe the robbery never even happened...

By the way, in the video contained in the blog of 3 September I explain that we came to England from Dublin in 2003 and for two years attempted to start a network of those abused by church with our own money and how the opposition we encountered was so great that we had no choice but to go on benefits in 2005. Of course, a year later we were forced to the street (see previous blog). But didn't I say we encountered tremendous opposition?

This short clip exposes how the police, the Catholic church and the state conspired to cover up a priest's suspected role in one of the worst atrocities of the Northern Ireland Troubles.

Highgate Jobcentre Plus doesn't disappoint

For over a month now, Declan has been spending money we don't have on registered letters to, among others, the manager of our jobcentre, Highgate Jobcentre Plus, regarding Action for Employment (A4E) - a private sector company that has £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions (DWP). This morning when Declan and I attended the jobcentre to sign our declarations it was more of the same: what letters? (The previous blog Letter to the Secretary of State for Work and Pensions has the background to the story so I won't repeat it here.) Having been forced to live rough on the streets of London for more than 2 1/2 years because Declan did not "sign on" TWO DAYS BEFORE he was due to do so on 29 September 2006 (see blog of 21 June 2010 Department for Work and Pensions double breaches the Data Protection Act: Letter to the Information Commissioner), we are under no illusion that the DWP is overly concerned about the law being on our side. So this is Declan's email to the chairman and owner of A4E, Emma Harrison CBE (see blog of 12 August Chairman of A4E in the spotlight; a steel worker's daughter, 43 year old Harrison is Britain's richest female entrepreneur):

In our situation, it is natural for us to empathise with Julian Assange, the founder of Wikileaks, who is the target of a US Government smear campaign to destroy Wikileaks's effectiveness by discrediting their leadership, splitting them off from their supporters and donation base - we are actually tenants in the same house MI5 whistleblower David Shayler lived in for a couple of years; Shayler now goes by the name of Delores Kane, and has declared himself to be Jesus (see blog of 2 June More electronic harassment? Fifth TV rendered useless for a shocking photo of Shayler being removed from a squat). I have found a good article which deals with just how credible are the sexual allegations against Assange. Army Private First Class Bradley Manning, aged 22, has been held in isolation since May, charged with releasing classified documents to Wikileaks. One of those documents is a 2007 video that shows American troops shooting and killing 12 people, including two Reuters employees.

Letter to the Secretary of State for Work and Pensions

We have to sign on tomorrow morning at our local jobcentre, Highgate Jobcentre Plus, and we are certain there is something there in store for us (see previous blog New email to the chairman and owner of A4E). Basically, Action for Employment (A4E) - a private sector company that has £300 million of Government training contracts and controls 25% of the long-term unemployment budget for the Department for Work and Pensions - wants Declan to amend his existing jobseeker's agreement, dated 26 July 2010, in such a way that would enable them to, among other things, put him in any job of their choosing. According to Section 9(6) of the Jobseekers Act 1995, a claimant can ask for a proposed jobseeker's agreement to be referred to a decision maker, which is what Declan has done. A4E refused (although they have yet to do so in writing), and have even gone so far as to have him removed from their premises by the police (see blog of 3 September Declan's case against A4E on YouTube video; this video is also now in NAC About, where an updated version of it will remain).

Registered letters to the chairman and owner of A4E, Emma Harrison CBE (see blog of 12 August Chairman of A4E in the spotlight) and to the manager of the Jobcentre are not acknowledged - not even when one of A4E's Advisers, the Rt Hon David Blunkett, a former Secretary of State for Work and Pensions, seeks a response! I have already written that if we don't step our game up, we are back to the street (see blog of 26 August A4E seek to have our benefits suspended/terminated with a telephone call), so this is Declan's email to new Secretary of State for Work and Pensions Iain Duncan Smith, the main content of which was dispatched to him by registered post this afternoon in letter format:

As I stated in the blog of 28 August Perhaps the Department for Work and Pensions will understand YouTube videos, I have started to produce YouTube videos with the intention of reaching out to other targeted individuals, people who, like us, are at the receiving end of covert action. Everybody knows the founder of Wikileaks, Julian Assange, who is at the moment battling allegations of rape - he must be exceptionally good at multitasking! This particular propaganda is already having an effect, and some fellow Wikileaks activists, including an Icelandic parliamentarian, are considering asking him to step down from his role as the group's public face, or ousting him if he won't leave voluntarily. Anybody wanting to know just how effective propaganda is in the control of information and thought, should spend two minutes watching this trailer for the new film Psywar.

Emails and registered letters to the chairman and owner, Emma Harrison CBE (see blog of 12 August Chairman of A4E in the spotlight) are not acknowledged - not even when one of their advisers, the Rt Hon David Blunkett, a former Secretary of State for Work and Pensions, seeks a response! I have already written that if we don't step our game up, we are back to the street (see blog of 26 August A4E seek to have our benefits suspended/terminated with a telephone call), so this is Declan's latest to Harrison:

It was Gilad Atzmon, an Israeli political commentator, who explained - prior to the international symposium on the war on terror in London last July that was organised by Declan with NAC Honorary Associate Dr Jim Fetzer (see blog of 26 August A4E seek to have our benefits suspended/terminated with a telephone call) - that there is a bigger war going on and it is a war against freedom of expression. It seems that evidence shows he is right. Why, otherwise, would police be taking photos of just about anyone attending political meetings here in London (see caption below)? I suppose that to run a network of those abused by church is also seen as exercising freedom of expression, which would explain why there is yet another attempt to put us back to the street, where the Department for Work and Pensions has already had us for more than 2 1/2 years.

Sisters of Mercy revisited - our first YouTube video

This morning the NAC website was nowhere to be seen and I thought that my new hosting company, JustHost, rated the most reliable hosting company in the UK (see blog of 8 August NAC new domain: churchandstate.org.uk), had even closed my account because I couldn't get access to it (graphic below). Two hours later everything was back. On 15 August, 27 Categories and 77 Tags I had at that time were deleted from my WordPress, only to reappear less than an hour later (see graphic here). And NAC pages have also been slowed down with this hosting company to a virtual standstill (see video here), although they are fine now.

The NAC website, first launched in October 2004, has in fact been removed from the internet on three distinct occasions (see About). Most notably, the website was suspended in March 2008 due to a Spamcop report that was drawn up the day after the Home Office denied that a warrant had been issued to intercept Declan's communications!

Below is a video for YouTube which we recorded earlier this week. We revisited some of the places we frequented during the more than 2 1/2 years we were forced to sleep rough on the streets of London by the Department for Work and Pensions. One such place is the RC Sisters of Mercy Dellow Centre, where we were robbed of all our money and documents the morning Declan was due to send his second Request for Priority to the European Court of Human Rights (see here). We are trying to reach out to other targeted individuals before we are forced back to living rough on the streets (see previous blog Declan's case against A4E on YouTube video).

The canteen area, which can be seen here, is where we were robbed during the few seconds that Declan did not have our bags in his line of sight (see blog of 18 June Declan robbed in the Sisters of Mercy Dellow Centre). The case was shut down by the police after the nuns refused to provide them with CCTV coverage of the robbery (see blog of 25 June 2008 Police 'No sleeping' sign in the porch):
