Interception of our communications: We never receive a fee remission letter from the Central London County Court issued on 2 March 2015

Part 1: Heavey v Single Homeless Project: Will the Central London County Court rule we consented to declarations for online referral that we are paying our own salaries and that we are both mentally ill, and despite our photographic evidence to the contrary?

Last week Declan made a call to Her Majesty's Courts and Tribunals Service (HMCTS) about the refund of a hearing fee owing to him since he submitted his remission application to the County Court at Central London two months ago to the day. (For information about this case see the link above.) HMCTS states that "For all remission applications, your application (EX160) will be processed within five working days of when it is received." We never received a remission letter HMCTS say they issued on 2 March, and we only received our refund cheque through the post an hour ago. Declan is currently working on his updated complaint to the United Nations under Article 19 (freedom of expression) of the International Covenant on Civil and Political Rights. This is his paragraph 40 relating to the interference with our communications (see new "threat to life" paragraph 36 here):

40. The Applicant further complains that the extent of the manipulation and control of his and his wife’s emails has resulted in the shelving for over three years of his petition to the United Nations in support of human embryonic stem cell research, and this despite the fact that the petition has been signed by 29 Nobel Prize winners as well as hundreds of other distinguished scholars from around the world. In April 2010, an associate of the Applicant’s in America wrote to Home Office Minister Lynne Featherstone, stating: “I am truly appalled by the unlawful violation of the Heavey’s basic right to send and receive email without interference. I would be most grateful for anything you may be able to do by way of taking measures to correct this gross abuse.” Despite Minister Featherstone’s letter of 16 June 2010 to the Home Secretary regarding the interception of the Applicant and his wife’s emails (see paragraph 6 above), the Home Office never explained why their email was being interfered with, a problem that persists to this day. The Applicant has also amassed irrefutable evidence relating to the sabotage of his and his wife’s mail, including the non-delivery of registered items. In the case of Heavey v Haringey Council (see paragraph 24(1) above), the Applicant was denied an oral hearing which he otherwise would have been entitled to had he received an order from the Court when it was sent to him. Subsequently, the Applicant’s application for an order extending time for renewing his application for permission to apply for judicial review to an oral hearing and for the file of his claim to be re-opened was refused by Mitting J (see Annex 12, Haringey Council: Order by High Court Judge Mitting, p. 35). On 10 July 2013, the Applicant complained to Secretary of State for Work and Pensions Iain Duncan Smith about the Department for Work and Pensions (DWP) and its manipulation of data on his joint claim for Jobseeker’s Allowance, including, but not limited to, changing the Applicant’s wife’s name on the claim without her consent or authorisation (see Annex 9, Department for Work and Pensions: Complaint to Secretary of State re manipulation of data, p. 27). The Applicant was subsequently twice sanctioned on a new claim for jobseeker’s allowance that he never made (see paragraph 31 above). On 24 March 2015 the Information Commissioner’s Office emailed the Applicant about the DWP’s processing of his personal data under the Data Protection Act 1998, stating (see Annex 10, Department for Work and Pensions: Reply from the Information Commissioner’s Office, pp. 28-29):

From the information provided it appears that DWP might have breached the DPA as it failed to keep your personal information accurate and up to date in accordance with the fourth data protection principle. However, we do not consider that further action is required at the moment. This is because we do not consider that there is an opportunity to improve DWP’s information rights practices, DWP is not a data controller that is identified as a concern to us.

Bedroom Leak - Housing Ombudsman Service provides us with a case reference number (Case ID 201415749)

We have been waiting over five months for our landlord Family Mosaic Housing Association to resolve the issue of our bedroom leak, which became a 5-foot fracture over our heads last month. This morning Declan requested that statutory compensation be added within the resolution process, as a follow-on to this update email yesterday to the Housing Ombudsman Service:

Single Homeless Project seeking to illegally break their contract with the Mayor of London's Housing First Project in respect of our tenancy. We are forced to initiate High Court proceedings against the Greater London Authority.

Declan is currently working on his updated complaint to the United Nations under Article 19 (freedom of expression) of the International Covenant on Civil and Political Rights. This was his paragraph 36 before the High Court pre-action letter above:

36. On 15 May 2014, over a year after having been forced into street homelessness for the second time on 14 April 2013 (see paragraph 25 above), the Applicant and his wife signed a two-year tenancy agreement on a housing association flat. They are clients of the Mayor of London's Greater London Authority (GLA) Housing First Project, and are housed by the Single Homeless Project (SHP), one of three charitable organisations that operate GLA Housing First. The Applicant has acquired a copy of the Agreement for the Provision of Funding Relating to the Housing First Project between the GLA and SHP. It states: "[Clients] will be offered long term tenancies.... Long term tenancies would mean for a minimum of two years with the possibility to extend and preferably for the lifetime of the client." This has been corroborated in academic publications, including a report from the University of Kent, which states that the Housing First model places homeless people "into permanent independent tenancies, with comprehensive yet non-compulsory, support". Nonetheless, on 4 September 2014, the Applicant received an email from SHP stating that GLA Housing First was terminating at the end of March 2015 and that the Applicant and his wife would have to be referred to another programme that the Applicant contends breaches SHP's legal obligation towards GLA because it does not provide the permanent accommodation and voluntary support characteristic of GLA Housing First; indeed, the Applicant and his wife do not even qualify for this other programme because they do not require support to live independently. On 9 March 2015, and despite the Applicant's protestations, he and his wife were referred by SHP to this other programme and told they were no longer GLA Housing First clients. The Applicant contends that this illegal manoeuvre by SHP will inevitably result in him and his wife being evicted from their flat and constitutes a serious threat to life (see paragraph 38 below).

Bedroom leak first reported to Family Mosaic Housing Association on 25 September 2014: Will we have to wait another 5 months for the repair of a 5-foot fracture over our heads?

Part 1: Heavey v Single Homeless Project: Declan gets his Central London County Court hearing date at last




Declan has been trying since last September to get a date from our landlord Family Mosaic Housing Association or their roofing contractor Glorcroft Limited for the repair of what became a 5-foot bedroom ceiling leak last month. Two weeks ago, on 24 February, Declan tried in writing once again only to receive a phone call from Glorcroft three days later promising him an update phone call last week that never came. According to Family Mosaic's website, an urgent repair such as a leaking roof is fixed within seven days (even routine repairs are fixed within 28 days). We have been waiting over five months for this repair to be put behind us, with seemingly no end in sight. This is Declan's email two weeks ago to the parties involved for his records:

Declan is currently working on his updated complaint to the United Nations under Article 19 (freedom of expression) of the International Covenant on Civil and Political Rights. This is his revised paragraph 12 concerning discriminatory surveillance:

Nothing to hide, nothing to fear?
12. It is important to underscore that the discriminatory surveillance suffered by the Applicant and his wife is not an isolated event. Rather, it is emblematic of a larger pattern of surveillance by law enforcement officials in the UK that has been well-documented by international and domestic human rights bodies. In May 2012 Liberty, one of the UK's leading civil liberties and human rights organisations, expressed concern that "state sanctioned surveillance against specific individuals takes place on a massive scale". British police and government agencies are requesting personal information about Facebook users more than almost anywhere else in the world (behind the USA and India), according to the company's Government Requests Report 2013. Since the Guardian began publishing material leaked by US whistleblower Edward Snowden in June 2013, there have been a spate of top secret GCHQ documents reported on and published around the world. On 19 February 2014 Intercept journalist Glenn Greenwald, through whom Snowden's revelations came to the world, listed some of these documents: "They include detailed reports on GCHQ's attempts to compromise basic encryption methods used to safeguard internet security, the GCHQ's role in spying on the Brazilian oil company Petrobras, the GCHQ's targeting of UN charities and officials, the GCHQ's use of 'dirty tricks' including 'honeytraps' and fake victim blog posts, the GCHQ's attacks on 'hactivists', GCHQ's surveillance of YouTube and Blogger activity and related activities to covertly influence internet discourse, GCHQ's surveillance through phone apps such as 'Angry Birds', and GCHQ's covert monitoring of visitors to the WikiLeaks website." In February 2014, the Independent reported that GCHQ's online covert actions follow the "4 D's": deny, disrupt, degrade, deceive. Privacy groups have now commenced lawsuits against GCHQ for the use of malware to spy on mobile and internet users across the UK.

Our Facebook "Like" counter is reduced in number and frozen after I post link in this blog to "How Covert Agents Infiltrate the Internet to Manipulate, Deceive, and Destroy Reputations" (WITH UPDATE)

Part 1: Heavey v Single Homeless Project: Will the Central London County Court rule we consented to declarations for online referral that we are paying our own salaries and that we are both mentally ill, and despite our photographic evidence to the contrary?

Last September and October our Church and State website at churchandstate.org.uk was blocked by our web host because we exceeded our limit of 25,000 visitors per month. In October we exceeded the limit in less than three weeks, so we had to upgrade a notch to be able to cope with up to 100,000 visitors per month. Last Sunday not only was our Facebook "Like" counter reduced in number for the upteempth time, but it hasn't moved since; coincidently, I had just posted a link in Sunday's post to "How Covert Agents Infiltrate the Internet to Manipulate, Deceive, and Destroy Reputations" as I do, again, below.
