Our problems with Facebook continue: They say I have shared a post that may be considered "insensitive or cruel" (WITH UPDATE 4/1/2017)

Bet the Pope has no trouble posting on FACEBOOK and his "insensitive or cruel" opposition to the use of safe voluntary methods of family planning including the right to abortions makes me wonder at the consistency of the criteria FACEBOOK uses to make its judgments. Of course FACEBOOK has such a right as a private service provider, but one can only point out that the diversity of views expressed by FACEBOOK users must include those which encompass family planning, whose availability helps avoid such "insensitive or cruel" moments in a woman's life when faced with an unwanted pregnancy which could have so easily been avoided with modern contraception. Go figure, FACEBOOK.

RE: Facebook

Following 17 Facebook blocks since 1 December 2015.

For the attention of Mark Zuckerberg, Chairman, Chief Executive and Co-Founder of Facebook:

31 December 2016

Dear Facebook,

This morning I couldn't gain access to your website without first getting past the following notice:

Your post was reported

Someone you've shared this post with reported it to us for review.

We've reviewed the post and found that it follows the Facebook Community standards, but may be considered insensitive or cruel. You may want to consider removing the post or limiting the audience you share posts like this with.

Please can you tell me what post I should review?

Yours faithfully,

UPDATE 4 January: Facebook still have not identified the post I shared that they say may be considered "insensitive or cruel". They never responded to any of the previous 17 block appeals I made this past year so I am not surprised really; in fact, to the best of our knowledge, Facebook UK Managing Director Steve Hatch never replied to Shadow Home Office Minister Lyn Brown (see her letter above). Perhaps the post Facebook is referring to is our Article of the Week that has received 1/2 million social recommends and 654 comments to date:

Cardinal Burke: Gay couples shouldn’t be invited to family gatherings if children are present

There can be no doubt that it is "insensitive or cruel" to say that gay couples shouldn't be invited to family gatherings if children are present. But I didn't say that. Cardinal Raymond Burke did!

Letter before action against Mail Boxes Etc. (UK) Ltd: Breach of contract[Information Commissioner's Office Case Reference Number RFA0651773]

Declan is still waiting to hear from HM Revenue and Customs (HMRC) about the stop they put to correspondence being issued to us because of the postcode on the mailbox we rent from Mail Boxes Etc. (UK) Ltd (MBE). This morning the Information Commissioner's Office came back to us stating:

Royal Mail has advised in their e-mail of 22 November 2016 that PAF (Postcode Address File) is a list of addresses and does not contain any personal data.

This means that you cannot be identified from your address on PAF.

The Data Protection Act does not apply to the issue you have raised because it does not concern your personal data.

This means that our dispute with MBE is exclusively contractual. Are we going to be forced to file our claim against MBE in the Central London County Court on 3 January 2017? That all depends on how HMRC respond to Declan's email to its chief executive on 29 November, which is posted to my updated blog post below.

Google freeze our stats at 1pm on 18 December 2016 after we exceed 1/4 million hits in six days and despite Facebook's 17th block since 1 December 2015

For the first time ever Google have stopped reporting on daily traffic to our Church and State website. They froze our stats at 1pm yesterday:

Actually, at 8.38pm yesterday, for example, we had 631 visitors in the previous 30 minutes:

We have no idea how many hits we had yesterday, but this screenshot shows that we had exceeded 1/4 million hits in the previous six days (12-17 December) notwithstanding Facebook's 17th block against our Church and State website since 1 December 2015 (9-14 December):

Previous reporting on GCHQ established its focus on what it regards as political radicalism. Beyond JTRIG's targeting of Anonymous, other parts of GCHQ targeted political activists and groups deemed to be "radical", even monitoring human rights NGOs. Mail Boxes Etc. UK: Declan writes to the Information Commissioner's Office in a last desperate attempt to try and resolve the issue of our registered office address without a court order (WITH UPDATE 19/12/2016)

Unbelievable.

Donald A. Collins, President of ISAF, Washington DC

RE: Mail Boxes Etc. (UK) Ltd (MBE)

Complaint about MBE under the Data Protection Act 1998.

To the Information Commissioner's Office:

12 December 2016

Dear Casework Team,

I refer to the below email from Royal Mail in respect of the new postcode on my mailbox which prevents me from receiving mail from Her Majesty's Revenue and Customs (HMRC). Please note that my problem is not with Royal Mail but with Mail Boxes Etc (UK) Ltd (MBE).

Royal Mail have subsequently made it clear that their hands are tied and that they were merely following instructions on 21 October 2016 when they changed the postcode on the mailbox I rent from MBE Kings Cross from N1 9JY to N1 9FQ. Consequently, HMRC have continued their stop on any correspondence being issued automatically to me because the building number of my mailbox at 254 Pentonville Road does not show on Royal Mail records under postcode N1 9JY.

In response to my letter before claim (please see attachment), MBE changed the address on their website to N1 9FQ. However, this postcode has subsequently been rejected by Companies House because they only accept the postcode N1 9JY for a building name or number on Pentonville Road; the postcode N1 9FQ is unique to the MBE business name. Royal Mail have told me that they would be happy to have 254 Pentonville Road listed on the postcode N1 9JY, but that they must receive this instruction from MBE.

The Retail Ombudsman cannot investigate a business-to-business context. However, this matter is also relevant to the Data Protection Act 1998 as principle 4 states that "personal data shall be accurate and, where necessary, kept up to date". I am considering court action and, given the problems with my mail from HMRC, time is of the essence. By way of alternative dispute resolution, can you still consider my concern as I did not receive a satisfactory response to the issue raised with MBE?

With reference to the below email from Royal Mail, please note that I cannot add my business name to the new MBE address as an alias identifier for the simple reason that N1 9FQ is not recognised by Companies House.

Yours sincerely,

Declan Heavey
Managing Director

UPDATE 19 December: Declan sent the email above to the ICO on 12 December. We are waiting to hear back from them. Depending on how HMRC respond to Declan's email to its chief executive on 29 November (see link below), we may not be able to wait much longer without issuing court proceedings against MBE for breach of contract. Currently we are paying for a registered office address with MBE Kings Cross that Companies House will not accept as amended by MBE on 21 October, meaning we cannot register an address for the company with HMRC that HMRC will not render invalid with their "automatic data cleanse" every 6-12 weeks, according to HMRC themselves on 19 October. You couldn't make it up!

Facebook's 17th block against our Church and State website since 1 December 2015 (WITH UPDATE - DAY 7 15/12/2016)

Glad you compiled this odious record of mistaken blockage. What possesses the site? Surely after multiple postings they must know your content is neither lewd nor extreme.

Donald A. Collins, President of ISAF, Washington DC

We are calling this Facebook's 17th block since 1 December 2015 - in the video above they even call it a block themselves. This evening Facebook stopped me from posting to groups without first passing through a time-consuming security check for every post I wish to make, and this for an undisclosed period of time and without any stated reason. Normally they block me from joining and posting to groups. These blocks have been extended seemingly for the fun of it, and to date have run up to six days at a time. I only post to groups articles that I have published on our Church and State website. I also only post to groups that are specific to an article's subject and that I am well familiar with; in fact, I am extremely careful on Facebook but it hasn't made a blind bit of difference for over a year now. Facebook did not respond to any of my previous sixteen appeals, so I'm not expecting a response to my appeal this evening. It reads:

For the attention of Mark Zuckerberg, Chairman, Chief Executive and Co-Founder of Facebook

9 December 2016

Dear Facebook,

I wish to appeal your decision this evening to stop me from posting to groups without first passing through a time-consuming security check for every post I wish to make (called by Facebook a "block"), and this for an undisclosed period of time and without any stated reason.

I have not posted to groups at all today, and yesterday I only posted to groups that are specific to an article's subject and that I am well familiar with.

I have made a video of the security check I must pass through to post to groups; it can be viewed at https://youtu.be/RHBslHY0gtk. In this instance, I tried to post an article titled "Freedom Of Expression And Religion: Salman Rushdie’s Critics" to an atheist group I actively participate in almost on a daily basis.

This is Facebook's 17th block since 1 December 2015.

1st 1-4 December 2015 (4 days)
2nd 5-7 December 2015 (3 days)
3rd 6-9 January 2016 (4 days)
4th 12-15 January 2016 (4 days)
5th 20-22 January 2016 (3 days)
6th 13-16 February 2016 (4 days)
7th 23-26 March 2016 (4 days)
8th 20-23 May 2016 (4 days)
9th 25-30 May 2016 (6 days)
10th 1-3 July 2016 (3 days)
11th 7-8 September 2016 (2 days)
12th 21-22 September 2016 (3 days)
13th 27-28 September 2016 (2 days)
14th 29 September - 3 October 2016 (5 days)
15th 4-5 October 2016 (2 days)
16th 18-23 October 2016 (6 days)
17th 9 December 2016 (ongoing)

Facebook has not responded to any of my previous 16 appeals, notwithstanding that I only ever post to groups that are specific to an article's subject and that I am well familiar with. I also only post to groups articles that I have already published on our Church and State website.

"Surely after multiple postings [Facebook] must know your content is neither lewd nor extreme," writes Don Collins, President of the International Services Assistance Fund, Washington, DC. Don often sends us material to publish on our Church and State website.

2 October: Complaint to Facebook Chairman, Chief Executive and Co-Founder Mark Zuckerberg on day 4 of Facebook's 14th block since 1 December 2015

RE: Facebook

Draft paragraph 42 of Declan's next updated complaint to the United Nations under Article 19 (freedom of expression) of the International Covenant on Civil and Political Rights.

42. On 13 August 2011, then Home Office Minister Lynne Featherstone wrote to Facebook on the Applicant's behalf, asking that they explain why the Applicant's wife had been barred. The bar was subsequently lifted; however, since 1 December 2015, Facebook has blocked the Applicant's wife from posting to pages and/or groups on seventeen separate occasions, and up to six days at a time. On 22 December 2015, Shadow Home Office Minister Lyn Brown made an enquiry on the Applicant's behalf to Steve Hatch, the Managing Director of Facebook UK, asking if he could offer an explanation as to the terms and conditions the Applicant's wife was alleged to have broken twice previously. To the best of the Applicant's knowledge, Mr Hatch did not respond to this letter. The Applicant's wife only ever posts to groups that are specific to an article's subject and that she is well familiar with, and she only ever posts articles that she has already published on the Church and State website. Nonetheless, Facebook has not acknowledged or responded to any of the Applicant's wife's seventeen appeals since 1 December 2015. Each of the following blocks are well accounted for in the Applicant's wife's N4CM blog:

1st 1-4 December 2015 (4 days)
2nd 5-7 December 2015 (3 days)
3rd 6-9 January 2016 (4 days)

8th 20-23 May 2016 (4 days)
9th 25-30 May 2016 (6 days)
10th 1-3 July 2016 (3 days)

UPDATE - DAY 7 15 December (2.46pm): Facebook upped the ante the day before yesterday on their 17th block since 1 December 2015 by preventing us from posting articles anywhere, even having gone through their security check. The unprecedented block below states: "You can't post this because it has a blocked link." Nonetheless, it appears today that the double block has been lifted, meaning this 17th block records as our third 6-day block this year. No reply to my appeal above. I have just updated my next blog post from two days ago, The blocks on access to our Church and State website continue unabated. I updated the blog post with the 69th block on access to our site since 26 July this afternoon.

Will it take the Independent Police Complaints Commission to protect our address with HM Revenue and Customs? (WITH UPDATE 22/12/2016)

Beyond belief.

Donald A. Collins, President of ISAF, Washington DC

RE: Her Majesty's Revenue and Customs (HMRC)

Complaint about serious staff misconduct involving criminal or near criminal behaviour overseen by the Independent Police Complaints Commission.

To HMRC Chief Executive Jon Thompson:

29 November 2016

Dear Mr Thompson,

I wrote to you on 27 September 2016 about my concern that HMRC letters addressed to me had been returned to HMRC undelivered.

According to SAIL Business Solutions on 27 September, their postcode had been used by HMRC as my own for the second year in a row. Subsequently, HMRC put a stop on any correspondence being issued automatically to me because 254 Pentonville Road was not showing on Royal Mail records under postcode N1 9JY.

This morning Mail Boxes Etc. changed the address on their website to N1 9FQ to reflect its listing on the Royal Mail Postcode Address File since 21 October 2016 (please see MBE's email below). I therefore confirm my business communication name and address as follows:

Declan Heavey
254 Pentonville Road
Suite 101
Islington
London
N1 9FQ

Please would you provide me with a letter confirming that HMRC have the correct address above and that HMRC will not change my address again without notification from me. I also request the removal of the stop on my correspondence from HMRC.

Yours sincerely,

Declan Heavey
Managing Director
Network for Church Monitoring

It's not like we don't have a history with the IPCC:
RE: Removal of our flat door

Paragraph 23(ii) of Declan's updated complaint to the United Nations under Article 19 (freedom of expression) of the International Covenant on Civil and Political Rights.

On 21 August 2012, Ms McKenzie signed an undertaking to the County Court promising not to harass the Applicant and his wife following her builder’s removal of the door to their flat (see Annex 9, p. 31). The Independent Police Complaints Commission later upheld the Applicant’s appeal against the police investigation of the incident "on information only", stating that "no further action is required by the force in this instance".

UPDATE 22 December: Only this morning have HMRC changed the communication address on our company contact details. Yesterday Declan found in the mailbox we rent from Mail Boxes Etc. this far from satisfactory response from HMRC to his complaint to its chief executive above (it only deals with self-assessment account contact details):

Surely it will not take a complaint to the IPCC to protect our company contact details with HMRC?

29 September: Complaint to HMRC Chief Executive Jon Thompson: Declan is still waiting for assurance that HMRC has our correct address

Ofcom refer Declan to the Postal Redress Service to solve the problem with our mail from HM Revenue and Customs (WITH UPDATE 29/11/2016)

On 19 October, Her Majesty's Revenue and Customs (HMRC) put a stop on any correspondence being issued automatically to us until they can verify our Mailboxes Etc (MBE) address through the Royal Mail database. On 22 October, MBE UK Chairman Simon Cowie wrote: "I can't see a solution to this at the moment. We have no power to make Royal Mail change their database, nor to make HMRC accept our [Kings Cross location] address for their records." This morning Ofcom referred Declan to the Postal Redress Service (POSTRS) to solve the problem with our mail from HMRC. Declan lists the details in his application to POSTRS as follows:

Her Majesty's Revenue and Customs (HMRC) have put a stop on any correspondence being issued automatically to me until they can verify my Mailboxes Etc (MBE) address through the Royal Mail database.

I rent a mailbox (Suite 101) from MBE at their Kings Cross location, 254 Pentonville Road, London N1 9JY. Currently, 254 Pentonville Road does not show on Royal Mail records under postcode N1 9JY. There are several flats at 252-254 Pentonville Road, N1 9JY, but no 254 Pentonville Road. On 22 October 2016, MBE (UK) Chairman Simon Cowie wrote: "I can't see a solution to this at the moment. We have no power to make Royal Mail change their database, nor to make HMRC accept our [Kings Cross location] address for their records."

According to Thames Water's website, there is an address for MBE Kings Cross (i.e. Business Mail Solutions Ltd, 254 Pentonville Road, London N1 9JY), but this address was rejected by HMRC because it could not be verified through the Royal Mail database. On 28 October 2016, HMRC Customer Service Manager Stephen Hughes wrote: "We have continued put a stop on any correspondence being issued automatically until your address has been updated."

On 18 November 2016, I requested from Royal Mail Chief Executive Moya Greene a full and final response from Royal Mail to my request that 254 Pentonville Road shows on Royal Mail records under postcode N1 9JY, so that I can receive my mail from HMRC. On 22 November 2016, I received Royal Mail's deadlock email. It informed me that, in accordance with a request from MBE on 21 October 2016, 254 Pentonville Road shows on Royal Mail records under the new postcode N1 9FQ.

I cannot use the new postcode N1 9FQ because it does not appear on MBE's website. I also cannot use the original postcode because 254 Pentonville Road is missing on Royal Mail's database under N1 9JY. MBE's website lists its Kings Cross location address as below:-

Mail Boxes Etc. London - Kings Cross
254 Pentonville Road
London
N1 9JY

I simply request that 254 Pentonville Road shows on Royal Mail records under postcode N1 9JY, so that I can receive my mail from HMRC. In a telephone conversation with Royal Mail Address Management Unit Manager Denise Boulter on 16 November 2016, I was told that the company did not have a complaints procedure for such a request (transcript available upon request).

UPDATE 29 November: This morning we received an email from Simon Cowie informing us that MBE had just changed the postcode on their website to N1 9FQ. Hopefully, this now solves the long-standing problem we have had with our mail from HMRC to our mailbox. Only time will tell I guess. This is Declan's email this afternoon to HMRC Chief Executive Jon Thompson:

29 November 2016

Dear Mr Thompson,

I wrote to you on 27 September 2016 about my concern that HMRC letters addressed to me had been returned to HMRC undelivered.

According to SAIL Business Solutions Ltd on 27 September, their postcode had been used by HMRC as my own for the second year in a row. Subsequently, HMRC put a stop on any correspondence being issued automatically to me because 254 Pentonville Road was not showing on Royal Mail records under postcode N1 9JY.

This morning Mail Boxes (UK) Ltd changed the address on their website to N1 9FQ to reflect its listing on the Royal Mail Postcode Address File since 21 October 2016 (please see MBE's email below). I therefore confirm my business address and personal contact address for HMRC records as below:-

Please would you provide me with a letter confirming that HMRC have the correct address above and that HMRC will not change my address again without notification from me. I also request the removal of the stop on my correspondence from HMRC.

Will St Mungo's get away with falsifying and fabricating data against us? I'm still waiting for Issuu to let me embed Declan's Witness Statement dated 14 November 2016

County Court at Central London, Royal Courts of Justice

The Small Claims Hearing of Declan's claim against the homeless charity St Mungo's under the Data Protection Act 1998 will take place on 20 February 2017 at the County Court at Central London. One day has been allowed for the Small Claims Hearing. At the Preliminary Hearing on 11 October, Declan explained to the Court that had the false, fabricated and nonsensical data St Mungo's produced against us have gone unchallenged, we could have been evicted from our home (a threat to life). St Mungo's have been given until 14 December to reply to this Witness Statement, filed at the Court yesterday:

I have contacted Issuu to report they are not letting me embed this Witness Statement (a first since I started this N4CM blog back in 2006). Until it automatically appears above, it can be read on their website at: https://issuu.com/lolaheavey/docs/witness-statement

In paragraph 26 of the Witness Statement, Declan refers to this court order that St Mungo's (then called St Mungo's Broadway) stood in defiance of for over eight months:

We were evicted from our previous flat on 14 March 2013 because according to our then live-in landlady's ex-husband, Dr Nigel McKenzie, a consultant psychiatrist in Highgate Mental Health Centre, our flat was needed for somebody with a mental illness. Former MI5 whistleblower David Shayler also lived with human rights activist Belinda McKenzie in the same political 'safe house' for a couple of years until 2007. According to BBC Panorama, Shayler "caused the biggest crisis of official secrecy since the spy catcher affair"; he was jailed for seven weeks in 2002 for breaking the Official Secrets Act. It is unfortunate that Shayler declared himself the Messiah in 2007, became a squatter, and was subsequently ridiculed in the press for changing his name to Delores Kane. A New Statesman article published in September 2006 featuring Shayler and Belinda gives no indication that Shayler believed he was the Messiah at that time; whilst a Daily Mail interview with him the following year reveals he believed himself to be Jesus by June 2007. He has never regained his normal self.

The Esquire article below* is mentioned in a Guardian article dated 27 March 2012. It is an eye-opener, highlighting the monitoring and surveillance that Shayler had to live with back in 2000, and the contradictory briefings and slanders that were coming out of the British establishment and the media. The author, Dr Eamonn O'Neill, is a lecturer in journalism at Strathclyde University.

*On 2 May 2013, Issuu removed this pdf from my Issuu account following a copyright complaint by Hearst Communications. I had uploaded the article to my Issuu account in December 2012. In March 2013, when last I checked, the article had been viewed more than 15,000 times. It can be read here.

The Institute of Chartered Accountants in England and Wales tell Declan he will hear from them next week (WITH UPDATE 8/11/2016)

Declan's former accountant owes him £686. I am prepared not to name him so long as we get this money back, and he properly changes Network for Church Monitoring's secretarial and registered offices with Companies House and Her Majesty's Revenue and Customs (HMRC).

UPDATE 8 November (3.10pm): This afternoon we received £686 from this accountant, but our registered office has yet to be properly registered with Companies House after three attempts by him or one of his colleagues. This is Declan's Small Claims Court Letter before Claim yesterday:

Declan is still trying to get Aitken to correctly amend our registered office address to Suite 101, 254 Pentonville Road, London N1 9JY. And this right under the nose of The Institute of Chartered Accountants in England and Wales (ICAEW Case No. 036415).

This Church and State blog has been decimated and I have no access to the TinyPic website (WITH UPDATE - DAY 4 7/11/2016)

UK Government Communications Headquarters (GCHQ)

The image I posted here has been vandalized/removed but appears in the update to this blog post below.

In this Church and State blog, we have found links broken and posts vandalised. This afternoon all the images in the blog that I have with TinyPic are missing, which means the entire blog has been decimated. Even the sidebar image I had for my previous disclaimer has been taken out. I have also been denied access to the TinyPic website, so this afternoon I emailed them instead:
4 November 2016

Dear TinyPic,

I cannot access the TinyPic website on any of my three laptops and all the images on my blog are not appearing either.

When I go to http://tinypic.com/ all I get is "XML Parsing Error: unexpected parser state". This is a screenshot of what my browsers get when I try to access your site: http://prntscr.com/d31aih (also attached).

And this is a screenshot showing my decimated blog: http://prntscr.com/d31jf9 (also attached).

Please can you resolve this situation.

Sincerely,

Lola Heavey

UPDATE 7 November (9.06am): I have not received a reply from TinyPic (Day 4). The images I have with them are back but the second image I had in this blog post has been subsequently vandalized/removed. This is that image, now saved to a memory stick, which shows what my previous disclaimer looked like when it appeared below the photo of GCHQ above:

RE: Government Communications Headquarters (GCHQ)

Paragraph 12 of Declan's updated complaint to the United Nations under Article 19 (freedom of expression) of the International Covenant on Civil and Political Rights.

12. It is important to underscore that the discriminatory surveillance suffered by the Applicant and his wife is not an isolated event. Rather, it is emblematic of a larger pattern of surveillance by law enforcement officials in the UK that has been well-documented by international and domestic human rights bodies. For example, GCHQ's Joint Threat Research Intelligence Group (JTRIG) specialises in the “4 D's”: deny, disrupt, degrade, deceive. It has been branded by the press as the spy agency's “deception unit”. Though its existence was secret until 2014, JTRIG has developed a distinctive profile in the public understanding, after documents from NSA whistleblower Edward Snowden revealed that the unit had engaged in “dirty tricks” like deploying sexual “honey traps” designed to discredit targets, launching denial-of-service attacks to shut down Internet chat rooms, pushing veiled propaganda onto social networks and generally warping discourse online. Previous reporting on GCHQ established its focus on what it regards as political radicalism. Beyond JTRIG's targeting of Anonymous, other parts of GCHQ targeted political activists and groups deemed to be “radical”, even monitoring human rights NGOs. Simon Davies, founder of the London-based Privacy International, asks: “If spying on human rights NGOs isn't off limits for GCHQ, then what is?”

Newham Council refuses to accept that Network for Church Monitoring is a company limited by guarantee, threatening the roof over our heads

On 11 October Declan attended a preliminary hearing at Central London County Court to battle a motion written by an expensive firm of solicitors, working pro bono, to strike out his case against St Mungo's under the Data Protection Act. It turns out there will be a one-day hearing of the case in the new year, but the next day we received a letter from Newham Council stating they have suspended our Housing Benefit because they were informed we had vacated our home. They're asking for so many proofs that Declan has indexed a 57-page bundle of documents. This is his complaint about the Council's refusal to accept Network for Church Monitoring as a company limited by guarantee:

Dear Mr Bromley-Derry,

Re: Complaint Failure to Make a Reasonable Decision

I refer to the attached document from Newham Benefits Service. I have repeatedly informed Abdul Karim that Network for Church Monitoring is a company limited by guarantee (as noted in Companies House).

The share capital (£2) is notional as the company is limited by guarantee and has no share capital. The share capital refers to the amount guaranteed by the members on liquidation. The company does not have shareholders or pay dividends.

Dear Mr Cowie,

Further to my e-letter dated 20 October 2016. I have this afternoon spoken with the Information Commissioner's Office (ICO).

Unfortunately, it takes the ICO up to six months to close 90% of their cases, therefore it is not an option by way of Alternative Dispute Resolution (ADR). Time is of the essence now that my revenue mail to the mailbox I rent from MBE King's Cross has been frozen by HM Revenue and Customs because Royal Mail does not have a proper address for the King's Cross location on its database.

Would you have an ADR proposal that will prevent litigation?

Facebook's 16th block against our Church and State website since 1 December 2015 (WITH UPDATE - DAY 7 24/10/2016)

Glad you compiled this odious record of mistaken blockage. What possesses the site? Surely after multiple postings they must know your content is neither lewd nor extreme.

Donald A. Collins, President of ISAF, Washington DC

We are calling this Facebook's 16th block since 1 December 2015 - in the video above they even call it a block themselves. Since this morning Facebook has stopped me from posting to groups without first passing through a time-consuming security check for every post I wish to make; and this for an undisclosed period of time and without any stated reason. Normally they block me from joining and posting to groups, blocks have been extended seemingly for the fun of it, and to date have run up to six days at a time. I only post to groups articles that I have published on our Church and State website. I also only post to groups that are specific to an article's subject and that I am well familiar with; in fact, I am extremely careful on Facebook but it doesn't seem to make a blind bit of difference. Facebook did not respond to any of my previous fifteen appeals, so I'm not expecting a response to my appeal tonight. It reads:

For the attention of Mark Zuckerberg, Chairman, Chief Executive and Co-Founder of Facebook

18 October 2016

Dear Facebook,

I wish to appeal your decision this morning to stop me from posting to groups without first passing through a time-consuming security check for every post I wish to make (called by Facebook a "block"); and this for an undisclosed period of time and without any stated reason. I haven't posted to groups at all today, and yesterday I only posted to groups that are specific to an article's subject and that I am well familiar with.

I have made a video of the security check I must pass through to post to groups; it can be viewed at https://youtu.be/N3iKqEwT9dM. In this instance, I tried to post an article titled "The Truth Seeker: 143 Years of Blasphemy!" to an atheist group I actively participate in almost on a daily basis. This is Facebook's 16th block since 1 December 2015:

1st 1-4 December 2015 (4 days)
2nd 5-7 December 2015 (3 days)
3rd 6-9 January 2016 (4 days)
4th 12-15 January 2016 (4 days)
5th 20-22 January 2016 (3 days)
6th 13-16 February 2016 (4 days)
7th 23-26 March 2016 (4 days)
8th 20-23 May 2016 (4 days)
9th 25-30 May 2016 (6 days)
10th 1-3 July 2016 (3 days)
11th 7-8 September 2016 (2 days)
12th 21-22 September 2016 (3 days)
13th 27-28 September 2016 (2 days)
14th 29 September - 3 October 2016 (5 days)
15th 4-5 October 2016 (2 days)
16th 18 October 2016 (ongoing)

Facebook has not responded to any of my previous fifteen appeals, notwithstanding that I only ever post to groups that are specific to an article's subject and that I am well familiar with. I also only post to groups articles that I have already published on our Church and State website, which has as Honorary Associates over fifty notable scholars from around the world.

Yours faithfully,

2 October: Complaint to Facebook Chairman, Chief Executive and Co-Founder Mark Zuckerberg on day 4 of Facebook's 14th block since 1 December 2015

RE: Facebook

Draft paragraph 42 of Declan's next updated complaint to the United Nations.

42. On 13 August 2011, then Home Office Minister Lynne Featherstone wrote to Facebook on the Applicant's behalf, asking that they explain why the Applicant's wife had been barred. The bar was subsequently lifted; however, since 1 December 2015, Facebook has blocked the Applicant's wife from posting to pages and/or groups on sixteen separate occasions, and up to six days at a time. Nonetheless, Facebook has not acknowledged or responded to any of the Applicant's wife's sixteen appeals since 1 December 2015. Each of the following blocks are well accounted for in the Applicant's wife's N4CM blog:

1st 1-4 December 2015 (4 days)
2nd 5-7 December 2015 (3 days)
3rd 6-9 January 2016 (4 days)
4th 12-15 January 2016 (4 days)
5th 20-22 January 2016 (3 days)
6th 13-16 February 2016 (4 days)
7th 23-26 March 2016 (4 days)
8th 20-23 May 2016 (4 days)
9th 25-30 May 2016 (6 days)
10th 1-3 July 2016 (3 days)
11th 7-8 September 2016 (2 days)
12th 21-22 September 2016 (3 days)
13th 27-28 September 2016 (2 days)
14th 29 September - 3 October 2016 (5 days)
15th 4-5 October 2016 (2 days)
16th 18-23 October 2016 (6 days)

UPDATE 24 October (1.08am): Facebook's 16th block since 1 December 2015 has been lifted. No response to my appeal above.

Heavey v St Mungo's: Declan's Opening Statement to the Court tomorrow morning (WITH UPDATE)

County Court at Central London, Royal Courts of Justice

Declan's preliminary hearing against the Greater London Authority-commissioned St Mungo's takes place tomorrow morning at the Central London County Court. This is his Opening Statement to the court:

It is St Mungo's contention that there was no need for this issue to be a matter of litigation as they were willing to address any concerns that I had about my records throughout. This is a misrepresentation of the material facts. St Mungo's only deleted the two action notes in dispute within days of this hearing, notwithstanding a Defence that alleged at para 5.b. that they had "rectified any errors or inaccuracies identified in the Action Notes". This has been the modus operandi throughout these proceedings that has caused great distress and financial hardship, not only because of the false, fabricated and inaccurate action notes that were created in the first instance, but also for all that St Mungo's has put me through to have these action notes deleted. I therefore request damages for distress and instead of my costs, punitive damages that will prevent a recurrence of these violations of the Data Protection Act. Alternatively, I respectfully request leave to appeal.

This is Declan's reply to St Mungo's Defence:

UPDATE 11 October (1.30pm): Despite St Mungo's insistence that the case should be struck out, a one-day hearing on the sole issue of damages will take place in the new year.

Will it take the Independent Police Complaints Commission to protect Declan's accounts with HM Revenue and Customs as they stand today?

RE: Her Majesty's Revenue and Customs (HMRC)

Complaint about serious staff misconduct involving criminal or near criminal behaviour overseen by the Independent Police Complaints Commission.

To HMRC PAYE and Self-Assessment Complaints:

5 October 2016

Dear Sir/Madam,

Further to my letter of 28 September regarding my complaint about serious staff misconduct involving criminal or near criminal behaviour, I wish to complain that my agent’s application online yesterday to add my email to my self-assessment contact details revealed that my address as effective from 28 September had been changed once again without notification from me or my agent. Please see my agent’s emails of 5 October and 30 September attached.

I called your customer service line this afternoon and informed them over the phone that they needed to change the address on my self-assessment to read 254 PENTONVILLE ROAD because my agent’s application online last week had been overruled and had simply corrected the post code. HMRC had once again changed the second line of my address to 252-254 PENTONVILLE ROAD which I pointed out in length is incorrect in my letter of 28 September. The correct address should read:

Suite 101
254 Pentonville Road
Islington
London
N1 9JY

Please provide me with a letter confirming that you have the correct address above and that you will not change it again without notification from me or my agent. Please also tell me the next step I need to take if I am not happy with your response. I would prefer not to have to bring this matter to the attention of the Independent Police Complaints Commission.

Yours faithfully,

Declan Heavey

Facebook's 15th block against our Church and State website since 1 December 2015 (WITH UPDATE)

This is Facebook's 15th block since 1 December 2015, preventing me from joining and posting to groups until tomorrow morning, and without any stated reason. These Facebook blocks have been extended seemingly for the fun of it, and to date have run up to six days at a time. I only post to groups articles that I have already posted to our Church and State website. I also only post to groups that are specific to an article's subject and that I am well familiar with; in fact, I am extremely careful on Facebook but it doesn't seem to make a blind bit of difference. Facebook did not respond to any of my previous fourteen appeals, so I'm not expecting a response to my appeal this afternoon. It reads:

For the attention of Facebook Chairman, Chief Executive and Co-founder, Mark Zuckerberg

4 October 2016

Dear Facebook,

I wish to appeal your decision this morning to block me from joining and posting to groups until tomorrow morning and without any stated reason. I haven't posted to groups today, and yesterday I only posted to a few atheist groups (no more than six or seven) that I am well familiar with.

This is Facebook's 15th block since 1 December 2015:

1st 1-4 December 2015 (4 days)
2nd 5-7 December 2015 (3 days)
3rd 6-9 January 2016 (4 days)
4th 12-15 January 2016 (4 days)
5th 20-22 January 2016 (3 days)
6th 13-16 February 2016 (4 days)
7th 23-26 March 2016 (4 days)
8th 20-23 May 2016 (4 days)
9th 25-30 May 2016 (6 days)
10th 1-3 July 2016 (3 days)
11th 7-8 September 2016 (2 days)
12th 21-22 September 2016 (3 days)
13th 27-28 September 2016 (2 days)
14th 29 September - 3 October 2016 (5 days)
15th 4-5 October 2016 (2 days)

Please note that I only ever post to groups that are specific to an article's subject and that I am well familiar with, and I only ever post articles that I have already posted to our Church and State website. Facebook has not responded to any of my previous fourteen appeals.

The bar was subsequently lifted; however, since 1 December 2015, Facebook has blocked the Applicant's wife from posting to pages and/or groups on fifteen separate occasions, and up to six days at a time. The Applicant's wife only ever posts to groups that are specific to an article's subject and that she is well familiar with, and she only ever posts articles that she has already posted to the Church and State website. Nonetheless, Facebook has not acknowledged or responded to any of the Applicant's wife's fifteen appeals since 1 December 2015. Each of the following blocks are well accounted for in the Applicant's wife's N4CM blog:

1st 1-4 December 2015 (4 days)
2nd 5-7 December 2015 (3 days)
3rd 6-9 January 2016 (4 days)
4th 12-15 January 2016 (4 days)
5th 20-22 January 2016 (3 days)
6th 13-16 February 2016 (4 days)
7th 23-26 March 2016 (4 days)
8th 20-23 May 2016 (4 days)
9th 25-30 May 2016 (6 days)
10th 1-3 July 2016 (3 days)
11th 7-8 September 2016 (2 days)
12th 21-22 September 2016 (3 days)
13th 27-28 September 2016 (2 days)
14th 29 September - 3 October 2016 (5 days)
15th 4-5 October 2016 (2 days)

UPDATE 5 October (8.05am): Facebook's 15th block since 1 December 2015 has been lifted. No response to my appeal above.

RE: Facebook

Complaint about 14 Facebook blocks since 1 December 2015.

To Facebook Chairman, Chief Executive and Co-founder, Mark Zuckerberg:

2 October 2016

Dear Mr Zuckerberg,

Our Honorary Associates include Nobel laureates Philip W. Anderson and the late Sir Harold Kroto.

Nonetheless, we are currently experiencing Facebook's 14th block against our Church and State website since 1 December 2015.

Please could you put a stop to these outrageous blocks.

Sincerely,

Declan Heavey

Day 3: Facebook's 14th block against our Church and State website since 1 December 2015 (with draft paragraph re Facebook for Declan's next updated complaint to the United Nations)

We are calling this Facebook's 14th block since 1 December 2015. Since 29 September, Facebook has blocked me from posting to groups without first passing through a time-consuming security check for every post I wish to make; and this for an undisclosed period of time and without any stated reason. They did not respond to any of my previous thirteen appeals, so I don't expect a response to my appeal below. We now have, however, a full-blown paragraph on Facebook for Declan's next updated complaint to the United Nations (further below). We also agree with our good friend and colleague in Washington DC, Don Collins, who wrote in response to my appeal: "Terrific!! The only way to win is to be the squeaky wheel that gets oiled!"

29 September 2016

Dear Facebook,

I wish to appeal your decision this evening to block me from posting to groups without first passing through a time-consuming security check for every post I wish to make; and this for an undisclosed period of time and without any stated reason.

I have made a video of the security check I must pass through to post to groups; it can be viewed at https://youtu.be/CkTFgZCg8MA. In this instance, I tried to post an article titled "Global overpopulation is the real issue" to Population Speak Out Discussions, a group I actively participate in almost on a daily basis.

Please note that I only ever post to groups that are specific to an article's subject and that I am well familiar with, and I only ever post articles that I have already posted to our Church and State website.

Yours faithfully,

Joseph McCabe (1867-1955), a former Franciscan monk who became one of the best-known champions and a prolific popularizer of freethought and rationalism in the first half of the 20th century, had this to say:

"The criticism of religion seems to be an unpopular job. I am, as more zealous and self-sacrificing purveyors of skepticism will assure you, really a timid and innocuous person, yet I have had my life threatened in Sydney and have been protected by friendly guns in Denver. I have heard ladies of Minneapolis regret that none had the courage to shoot me, and British Spiritualist clergymen have deplored in their journal 'Light,' that I have never yet had the horsewhipping which I have merited. Friends have rushed before me in the streets of London to protect me, they imagined, from a vitriol-thrower, and sailors have been bribed by clergymen of the southern seas to put my luggage ashore a thousand miles away from my destination. I have been forced by the pressure of the Catholic Church on a London publisher to tear up a literary contract worth at least twenty thousand dollars, and have had my books shamelessly misrepresented in the press and expelled, under menaces, from booksellers' shops. Insults, injuries, intrigues, lies, libels, vituperations, depreciations..."

What's changed?
