Malicious Intent Law - Legal Definition

Malicious intent refers to the intent, without just cause or reason, to commit a wrongful act that will result in harm to another. It is the intent to harm or do some evil purpose.

Following Declan's win against the Single Homeless Project in the Central London County Court on 8 May, we received this misaddressed and misdated letter from the charity's second in command two days ago:

SHP only have until close of business today to comply with District Judge Brooks' order. Earlier this week, Declan phoned Her Majesty's Courts and Tribunals Service to enquire about the sealed order that DJ Brooks assured him he would receive within two working days. He was told that the file was still with the Judge, however if need be we have this unsealed order to file in the High Court next week against the Greater London Authority (GLA):

By close of business last Wednesday, Greater London Authority Principal Solicitor Anna Condliffe had breached the pre-action protocol for judicial review by failing to respond to Declan's pre-action letter dated 6 May 2015. Perhaps a High Court judge will have to order compliance with procedural law before this solicitor, acting on behalf of the Mayor of London, retracts her misconceived threat to have us evicted from our home.

Our Church and State website is down for the third time (WITH UPDATES)

We lost our Church and State website on 23 April, but fortunately, it was our American web host SiteGround's Varnish caching service that was the culprit so we recovered it quickly. Six days before, on 17 April, SiteGround blamed our WordPress database, which then corrected itself. Now SiteGround is blaming high traffic towards the server and a corrupt WordPress theme script for intermittent outages we have been experiencing since Saturday morning. This means we now have to buy and customize another theme for the site, that is on top of having to file an action against the Greater London Authority in the High Court in order to protect our tenancy.

According to Google Analytics, and despite all the outages, this article alone brought over 100,000 people to our site over the last few days:

UPDATE 1 (20 May 2015, 8.50am): Our website has been down since 6.30pm yesterday evening. I ask SiteGround to tell us when we can expect to be able to access our site and phpMyAdmin. This note appears on our Support tab: "The server that hosts your account is experiencing problems at this moment. We kindly ask you not to submit tickets regarding the status of your website until we fix it." Our Support tab as it looks at the moment:

UPDATE 2 (20 May 2015, 11.26am): Following the restoration of our site, SiteGround asks us to bear in mind that they "perform regular maintenance related to software updates". I write back asking them if they could remove from our Support tab the note above stating that there are problems with the server, as it would appear from their response to be no longer applicable.

37. Furthermore, on 31 July 2014, the SHP sought the Applicant's signature on a support plan that stated that both his wife's blog (at http://network-of-those-abused-by-church.blogspot.co.uk) and their Church and State website (at http://churchandstate.org.uk) appear "to demonstrate" their thinking, that they "appear very grandiose" in their thinking, and that they both "demonstrate symptoms of mental ill health". This support plan was subsequently withdrawn; however, under the programme that the Applicant and his wife have been referred to by GLA Housing First, they would have faced eviction for non-compliance with such a support plan, thus adding further weight to their argument that the upholding of this referral by the Principal Solicitor of the GLA is unlawful. In fact, so intent was the SHP to hold these and other allegations against the Applicant and his wife, that the Applicant lodged a claim against the homelessness charity on 12 September 2014 before the County Court at Central London, challenging under the Data Protection Act 1998 the charity's claim that he and his wife consented to declarations for online referral that they were paying their own salaries as employees of N4CM and that they were both mentally ill. At a hearing of the case on 8 May 2015, the Court declared that SHP had acted unlawfully under the Act and ordered them to pay court costs and damages to the Applicant of £750. The Court took into account a strong rebuttal of SHP's financial and mental health accusations by N4CM Chairman Dr Stephen Mumford, founder and President of the Center for Research on Population and Security in North Carolina, USA. Dr Mumford attached with his mental health rebuttal of 15 August 2014 two of the Applicant and his wife's references for second jobs in care, one of which was written by a Harvard educated MD (then) based in London, stating:

I personally know Declan and Lola Heavey. I can, in good faith, recommend them as caregivers to an elderly person in need. If they were offered such a position, I am confident that they would carry it out with more than the usual commitment and care.

We were evicted from our previous flat on 14 March 2013 because according to our then live-in landlady's ex-husband, Dr Nigel McKenzie, a consultant psychiatrist in Highgate Mental Health Centre, our flat was needed for somebody with a mental illness. As Declan states in section 5, paragraph 14 of his High Court pre-action letter above, former MI5 whistleblower David Shayler also lived with human rights activist Belinda McKenzie in the same political 'safe house' for a couple of years until 2007. It is indeed unfortunate Shayler then declared that he was the Messiah, became a squatter, and was subsequently ridiculed in the press for changing his name to Delores Kane. A New Statesman article dated 11 September 2006 featuring Shayler and Belinda gives no indication that Shayler believed he was the Messiah at that time; whilst a Daily Mail interview with Shayler explicitly shows he believed himself to be Jesus by June 2007.


The Esquire article below* is mentioned in a Guardian article dated 27 March 2012. It is an eye-opener, highlighting the monitoring and surveillance that Shayler had to live with back in 2000, and the contradictory briefings and slanders that were coming out of the British establishment and the media. The author, Dr Eamonn O'Neill, is a lecturer in journalism at Strathclyde University.

BBC PANORAMA: The David Shayler Affair (August 1998)

According to BBC Panorama, Shayler "caused the biggest crisis of official secrecy since the spy catcher affair". In 2002, he was jailed for seven weeks for breaking the Official Secrets Act.
