Our Church and State website has no less than 59 Nobel Laureates on it; for details, see this blog's sidebar under "Church and State" (updated today). Article 10 of the European Convention on Human Rights and Fundamental Freedoms formulates what is the core of free speech. "Everyone has the right to freedom of expression." In an important interpretation of this article, the European Court of Human Rights in Handyside v. UK (1976) indicated that this "freedom of expression" should be construed as follows. It "is applicable not only to 'information' or 'ideas' that are favourably received, or regarded as inoffensive, or as a matter of indifference, but also to those that offend, shock or disturb the State or any sector of the population". Such are the demands of that pluralism, tolerance and broadmindedness without which there is no "democratic society" (see Cliteur, 2010).
Declan has commenced court proceedings against the Mayor of London-commissioned St Mungo's in the County Court at Central London in the Royal Courts of Justice.

Yesterday Declan received this email from the Executive Assistant to Althea Loderick, Chief Executive of Newham Council. We are left wondering will Declan next have to complain to the Complaints Department about how his complaint about volunteering at the Council has been handled and whether such a complaint would fall within the remit of the Local Government and Social Care Ombudsman.

11 January: Volunteering at Newham Council: Declan's complaint about the reduction of the volunteering he has done by 32 hours and more besides
In addition to travel expenses from Limelight Sports, Declan has not been receiving his joining instructions from Newham Council (Active Newham) for events of late; see my post of 27 December 2019, How many months will it take Limelight Sports to reimburse Declan's travel expenses for voluntary work? The Mayor of London-commissioned St Mungo's has made his volunteering at Newham Council highly relevant to court proceedings. Despite two reminders, Limelight Sports still has not reimbused Declan for his travel expenses to and from Hyde Park for the RBC Race For The Kids on Saturday, 12 October 2019. He has also been informed by the Council that going forward he will have to wait for up to 90 days for his volunteer hours to be loaded on their system; see my post of 2 January, Newham Council: The Local Government and Social Care Ombudsman will not investigate Declan's complaint of unfair treatment because it pertains to his voluntary work at the Council.
St Mungo's is funded by Mayor of London Sadiq Khan to run a number of his rough sleepers initiatives.

On 23 August 2018, Declan complained to the Information Commissioner's Office about case notes St Mungo's Executive Director Dominic Williamson assured the Court at trial in February 2017 had been rectified by him but were in fact being held under my name. It took the scheduling of a preliminary hearing in October 2016 to have case notes from two meetings so-called rectified by Williamson as Declan had requested all along; and that rectification only took place after a failed attempt by an international firm of solicitors, Osborne Clarke, to have Declan's claim struck out on the papers. The judge at the preliminary hearing dismissed St Mungo's application to strike out Declan's claim for compensation. DJ Avent's order dated 11 March 2017 does not state why he dismissed the claim at trial. Williamson: "The court case concerned your complaint about the notes on your record. My understanding is that following the court case it became apparent that the note in contention was mirrored on your wife's record - which I don't recall being aware of at the time - and this was subsequently amended to reflect the change we had made to yours. The court was therefore not misled." We strongly disagree that the court was not misled.

What the issue in these court proceedings boils down to is whether the Court will decide that Declan and I should face the prospect of eviction back to the streets (a death threat) rather than St Mungo's take a call to confirm that we are clients of theirs, and that such a position is not harsh, unjust and unreasonable.
