Last night: Declan replies to our landlord at 10.30pm. We are cut off the Internet for a record-breaking 45 minutes from 11.45pm

Our Church and State website has no less than 40 Nobel Prize winners on it; for details, see this blog's sidebar under "Church and State" (updated today).

The tenancy agreement we are being asked to sign is a shocking document (see here). This morning we wondered for how long we were going to be cut off the internet. It turned out to be a recording-breaking 45 minutes, from 11.45pm (11.46pm to be exact) last night until 12.30am this morning. Last night at 10.30pm Declan sent this email to our landlord:

Dear Ms Sogunro,

I refer to your response to my complaint of 22 May 2018. Both my complaint and your response are attached.

On 16 May 2018, St Mungo's TST Manager Gemma Goacher and Peabody Neighbourhood Manager Chantelle Mitchell agreed to the 'like-for-like' renewal of tenancy during a meeting with my wife and me at our home. However, two days later, on 18 May 2018, I received through the post a tenancy agreement that not only is far from a like-for-like contract, but that breaches Article 8 (protection of family life and home) and Article 14 (prohibition of discrimination) of the Human Rights Act (HRA).

Yesterday my wife, Maria [aka Lola], wrote to her St Mungo's Tenancy Sustainment Team (TST) Worker, Sofia Pires. Maria explained at length why another meeting to discuss this matter further is not reasonable. A reasonable course of action is to send us a renewed AST (RSI 2 year fixed term) tenancy agreement as agreed on 16 May 2018. I have been repeatedly stating for over a month that this would have to mean that Section A, part 6 'The date your tenancy starts' be amended to read as follows (like-for-like):

The tenancy starts on 17/05/18 and is a renewed assured shorthold tenancy for a fixed term of 2 years. (Emphasis added.)

This ought to then ensure that the rest of the agreement is brought into line with the HRA. Alternatively, a reasonable course of action would be to provide the Housing Ombudsman Service (HOS) with what they asked for from you by 2 July:

I have asked the landlord to write to you with an update on what is being done about your complaint, what stage the complaint is at, and how you can escalate it if you are not satisfied. If you have exhausted the Internal Complaints Procedure, I have asked the landlord to send you the final response.

The HOS asked to be provided with a copy. I can confirm that I have received no such response to date; and neither has HOS, according to themselves.

Yours sincerely,

Declan Heavey
